Hello all

I've read the whole thread before asking my question but didn't find anybody in the same situation as I am.

So, has anyone ever applied for a waiver after receiving a permanent ban for misrepresentation? Or have any of the regulars even heard of anyone who has?

Is misrep looked on as THE worst offense?

I take it I would apply for a B2 visa, get denied, then apply for permission to file a waiver. Am I correct?

How did you earn the ban, and how long ago was it?

In 15 years of following this forum and its predecessor, I don't remember hearing of anyone receiving a waiver (and, subsequently, a visa) following a permanent ban.

Moreso than murder! Yes... as it calls your credibility and integrity into question.

Yes, more or less. You don't actually apply for permission to file a waiver... it'll either be recommended by the interviewing officer or not. There's nothing to lose by trying... and from what I've read, it is possible to receive a waiver following a 212(a)(6)(c)(i) issue! You'll need to demonstrate why you need to be in the US... as opposed to simply wanting to be in the US... why you must be in the US - and that's going to be an uphill climb. Good luck to you!

The government does weigh the violation and the risk to the US against the applicants reasons for going. It may help to have a compelling reason to enter the US when seeking a waiver. However, it's not unheard of for someone to eventually get a waiver of 6C and/or other serious things to travel simply for tourism.

I don't know how to quote previous answers but just wanted to say to material controller that secondary was fine, took ten mins laughing and joking and the officer telling him to stop being trouble and behave himself!
Nearly gave my mum a heart attack though as I forgot to mention it and all she saw was us being escorted off into a back room!!
