Directorate of Enforcement orders confiscation of four properties of foreign nationals

Two days after the 50th anniversary of Goa's liberation from colonial rule the State government on Tuesday issued an advisory cautioning the foreign nationals and locals not to encourage or indulge in any property transactions in contravention of the provisions of the Foreign Exchange Management Act (FEMA), 1999.

The advisory comes in the wake of the Directorate of Enforcement, Mumbai, ordering confiscation of four properties of foreign nationals of non-Indian origin in Goa vide its adjudication order dated August 11, 2010, for contravention of FEMA.

The State government had constituted a committee under Mr. Anupam Kishore, Joint Secretary (Debt Management), for examining the cases related to acquisition of immovable property by foreign nationals.

The Committee found contravention of FEMA in about 480 cases which were forwarded to the Directorate of Enforcement for action.

The Directorate has issued show-cause notices in all the cases and adjudication process is on.

Adjudication orders have been passed in four cases, where contravention of FEMA has been established and orders of confiscation of property have been passed. The adjudication in other cases is expected to be finished shortly, government sources said.

An official spokesman told TheHindu on Wednesday that the government has been repeatedly issuing press statements cautioning foreign nationals against acquisition of immovable property in Goa by contravening the provisions of FEMA, 1999. The information about FEMA is also available on the website www.fema.rbi.org.in, he said.

The issue was highlighted in a new film in Konkani, “O Maria”, produced and directed by national award-winning filmmaker Rajendra Talak. The film, which was released on the eve of the anniversary of the golden jubilee of liberation on Sunday, deals with this complex but burning issue, where Goans in coastal areas invite doom by unthinkingly selling their ancestral properties, falling prey to manipulations of locals and foreigners. Some sell their land for mega projects which are poised to destroy the environment.

It also shows a well-meaning foreigner on a holiday in Goa who helps the villagers to unite to fight the unscrupulous land sharks and save their ancestral properties.

The information I refer to was in the 'Goan Voice Daily News Letter Tuesdy 21 December 2010' heading 'Goa Issues Advisory To Foreigners Regarding Property' and then read full text - which takes you to the Hindu Times article mentioning the film 'O Maria'.

yes, and a Google search brought up the article in The Hindu, and a bunch of sites that copy news items, and nothing else at all - I wonder if this really is current news or whether someone at the newspaper has picked up an old press briefing by mistake.
Does anyone know whether the Goa govt. has issued an new advisory?

Re press advisory - I think the press advisory is old and has been picked up before. As far as I can see, there was a Goa Government advisory at the very start of the problems and a national press notice appended to the RBI notification last July, the first time visa types were publically mentioned.

The two month out gap is definitely having an impact on regular visitors - those left are saying they will not return next year and from what I have heard many are upset at how the British community have been treated here over property issues.
