There seems to be some confusion about STATUS versus EMPLOYMENT AUTHORIZATION in this thread.

If the OP returns using AP, they will be a Parolee, which will be evidenced by the I-94 issued.

That's exactly how it worked for us as well.

I needed an ITIN, so I had to fill in a Form W-7 and attach the tax return to that.

The tax return was sent to the ITIN address rather than the one...

I certainly wouldn't rely on ANYONE in HR for an opinion on immigration matters! YMMV.

The top 5% comment might be more appropriate to EB1A and EB1B, but EB1C only needs to meet the criteria laid...
