wouldn't that be theft? They have a right to sue for damages. Have the
software companies, by insisting on you clicking that agreement box,
stolen our reasonable rights?

I doubt that will ever happen. Most of those terms are about removing
legal liability from the software producers anyway, and so by clicking
OK you simply weaken your legal recourse, even if you would be hard
pressed to prosecute any software producer for negligence.
