Even they cannot give a simple answer!

Given the recent success of the BJP in India this article could be very important!

Hi Enfield & all

Thats why I threw the question open to the "floor"

How about if Geoffrey downloads the names removes those real(sur) names that want removing, scans it, then sends the petition as an attachment to the Central Gov in India ?

Question "open "again to my learned Expats

Hi Kan-conned I think this would be a great idea take all the sir names and they couldn't possibly identify any individual. I say go for it, but it's up to the other on the forum
great job your doing old pal.I think it's vital that we keep the pressure on now whilst the publicity is bad for Goa
cheers

The BJP (currently the Opposition in Goa) want to amend the Constitution of India similar to the existing amendments to Article 371 for Himachal Pradesh etc. Amongst other things this is likely to include this clause:
371A. (1) Notwithstanding anything in this
Constitution,
(a) no Act of Parliament in respect of ...

(iv) ownership and transfer of land and its
resources,
shall apply to the State [...] unless the Legislative
Assembly [...] (approves it).
At present the transfer of land in Goa is controlled by the Transfer of Property Act 1908, which is a Union (i.e. all India) Act, and much as they would like to the Goa State government can't alter it (which is why they are playing fast & loose with the Registration regulations).
This Constitutional Amendment would let them pass their own laws to control the sale of land / property!

... that link wasn't very helpful because it's been archived - here is the latest Master Circular - but as far as I can see it doesn't answer the question (but the RBI site does have other Master Circulars on FRO accounts and remittances by foreign nationals, and these may be more helpful).

This may be what we need - it's FEMA itself:
#6(5) says:
A person resident outside India may hold, own, transfer or invest in Indian currency, security or any immovable property situated in India if such currency, security or property was acquired, held or owned by such person when he was resident in India or inherited from a person who was resident in India.

Chapter 2 Section 6 sub-Section 5 of The Foreign Exchange Management Act, 1999.
I suggest that every FN who has bought property and may wish to sell it should print that off from the link I gave, get it laminated, and carry it around with them forever!!!

Default Re: GOA Rukmini constructions please help

Hello, could anyone please help me, i had started buying a apartment at the Exotic Regencey phase 2 in Siolim which was due for completion in December 2008, this was being purchased through Churchill innovative solutions, i tried to ring them on monday to no avail i have since found out they have gone bust !!! It's a long chance but myself and others who have been affected are trying to contact the development builder whom i believe to be Rukmini Constructions, i have the bank account details in Mapusa and in Siolim, i do not know if they know of churchills demise as it seems sudden, Any contact information would be most grateful.
