Jags re-opens as a bar/resto with full licenses in place. They could also offer a membership, which I personally think was a great idea for up front financing. I did not personally take up the membership but did receive information about it as I know both partners and am on the Jags mailing list. There was a clause in the agreement saying if Jags closed for any reason before people had received their full benefits, they would have their monies or a percentage returned. This said, hopefully if Jags had closed sooner, the partners would have been prepared to honour this and return any monies owed. I also am disappointed at the situation as the more businesses on Esuri, the better for Ayamonte and the whole area. It would be great for Esuri for Jags to re-open and also encourage others to bite the bullet and maybe invest in other activities there. I forget all the details - but I actually thought there was no refunds etc, as did my friends that didn't invest. I wonder if there's any chance for the members to get a refund in reality :thumbdown: We didn't read the small print.... and I don't have the leaflet anymore..... thanks for explaining this Jon |

Of course.... I mentioned the very same point in my earlier post so was the one that bought it up. I also thought it was a risk/reward thing, till VS corrected me about a refund potential. I don't know the small print.... It's very messy and I don't see anyone taking legal action. We have no money lost so we are OK.... but if VS was right in his earlier post then one could argue that members were 'duped' by the partners..... as you are also implying (hypothetically)... ....... The original enterprise was set up in good faith by the original partners and 'investors' were invited to take out memberships with an excellent return in order to generate operating capital for the start-up. If anybody was unaware of the potential risks then they were extremely naive. I'm also doubtful whether the business set out to operate illegally. ISTR that the original opening was delayed because of some building irregularities which had been 'denounced' by a well-wisher!. The town hall presumably crawled all over the proposition before allowing the business to open. I suspect that what happened was essentially mission creep. The bistro was set up as a member's sports club (with I would guess the appropriate permission) - but soon started to allow the general public non-members - ie starting to sail close the wind which seems to be common practice in parts of Spain. This continued with a blind eye from the town hall until the furore about the near-drowning and the noise complaints meant that notice had to be taken.

I can only assume the following for CE: 1. Most homes on CE are holiday homes and they aren't used much except for the two busy months. Some estimate of how many permanent residents there are would help to provide confidence to anyone wishing to set up. 2. The owners of the designated shopping areas (is that Martinsa Fadesa?) are charging ridiculous rents. I don't understand this but assume it is in the Spanish psyche - do they not understand that a successful business encourages more. 3. The Ayamonte and Spanish system is too complex and bureaucratic for most people whether Spanish or otherwise to contemplate trying to see their way through if there are potential risks to their investment. What is the town hall doing to generate business on CE or do they simply not care? 4. Did Jag not consider opening his business in one of the proper designated areas where he would not have had the same problems. I know it would not have been as smart but at least he would have had a business. I only went a few times but feel sad for those of you who live on CE as you have lost a very nice facility. It might take a big community consortium to get a bar cum restaurant going on CE but someone will need to be the driving force behind it. The shares idea is a good one - would it work again? |

Yes, Bill, been eating to much cheese to have such ambitious dreams! Town hall officials preside over the EUC, they happily take money for that and eg IBI etc from thousands of homeowners here. However they don't think we are worthy of a bus service...... or even a post box!! :thumbdown: Crack open a wheel of Camembert - time to go to my dreamworld and imagine such lofty ideals!! Jon |
