Spain has signalled its willingness to kick-start adhoc talks, to the United Kingdom. The Spanish Foreign Secretary of State, Ignacio Ybañez, told members of the press in Spain that the talks would leave sovereignty issues to one side.

The Government says it is surprised to note that the Spanish paper ‘El Pais’ has written an article today on the UK’s, and more specifically, Gibraltar’s alleged non-compliance with the European Commission’s Habitats Directive.
The Government says that the investigation against the UK is more of a technical matter rather than a practical one and the main criticism made in respect of sites across the UK, including Gibraltar, is that the conservation objectives for EU protected species and habitats “are too high level and broad and therefore they do not effectively establish priorities for the maintenance or restoration, at a favourable conservation status, of EU protected habitats and species.”
“Ironically, however, the Spanish Government is actually in a far worse position given that the Commission has already initiated infringement proceedings for failing to discharge its practical obligation to designate Special Areas of Conservation (SACs) in the first place.
“In mid-July the Commission announced that it was taking Spain to the EU Court of Justice (CJEU) over poor waste management in the regions of Andalusia, Balearic Islands, Canary Islands, Castile- La Mancha, Castile and León and Murcia

the fact that no effort has been made to separate out those with passports and ID cards without microchips from those with microchips have, over the last few days, been the cause of the dramatic scenes at the border with large pedestrian queues of cross border workers, tourists, the elderly, children etc. all having to endure the high seasonal temperatures as well as the recent heat wave.

Serious SVA incursion at Sandy Bay
A Spanish customs vessel and helicopter chased a smuggler speedboat into Sandy Bay early Sunday morning and came to within metres of the shore, in a serious incident that is under investigation by the UK and Gibraltar governments.
As a Spanish helicopter hovered low over the beached rigid-hulled inflatable boat, the SVA deployed a small dinghy and entered the sheltered lagoon in Sandy Bay and headed to the shore, a spokesman for the Royal Gibraltar Police told the Chronicle.
As the SVA crew tried to tow the smugglers' RHIB away, a local police officer jumped on board and cut the towline.
The three occupants of the beached boat had already jumped ashore and tried to flee on foot
Police arrested two occupants of the RHIB, which was empty

At the moment there is an International Tribunal of the Law of the Sea (or something similar) sitting in Hamburg to judge on the Dispute between Italy and India regarding the 2 Marines that shot up a fishing boat killing 2 fishermen in what Italy purports were International waters. Odd that every day Italy arrests and tries the guys that steer the boats with the immigrants in International waters?
Maybe this tribunal should be invoked for the case of Gibraltar/Spain.

The FCO spokesperson said the Minister for Europe had written to his counterpart in Spain, making clear that they “want to see the same level of cooperation that exists between the UK and Spain, including against organised crime such as drug trafficking, extended to Gibraltar law enforcement agencies, on the water and at the border, without the unlawful incursions into British Gibraltar Territorial Waters that we have seen all too often in recent days.”

Maybe two totally different scenarios. The 2 marines were on escort duty on a ship threatened by Somali pirates; India has still not decided how to reslve the case after holding the men for nearly 3 years. The scafisti arrested after migrant rescue oprations are usually responsible for people trafficking and causing overcrowded dinghies to capsize and drown people. Maybe the ECG would be more appropriate for any Spain/Gibraltar disputes?

The scafisti generally are just other immigrants who get a discount, usually their crime is aiding and abetting but in Libyan or International waters. Jurisdiction, Italy can't have it's cake and eat it too. It's already making many peoples fortunes.
