If you are subject to UK inheritance tax you can't frustrate that by giving away the house that you continue to live in. Other than that, handing over assets in the way you suggest is tax efficient...

Sorry but you are mixing Disability Living Allowance and Incapacity benefit. In the former case this can last for life, in the latter any new claims since 2008 are under the Employment Support...

I think one problem with incapacity benefit (now employment support allowance) is that people with a physical disability (whether temporary or permanent) have been assumed to be incapable of any work...

I agree Scampicat. I just feel that too often all claimants are tarred with the same brush without any evidence. Anyway the UK Govt is obviously doing something to try and deal with fraud.

Seems to me you always were in negative equity and don't have any capital in the property, by definition. If the bank sell it will be as quickly as possible and could well leave a much bigger debt...
