"I know that there have been slight changes to the interiors on phase 2..but nothing that I would have thought would cause them not to issue the licence.
Duja obviously want this licence as it is costing them a lot of money." Unfortunately even the smallest changes in a new build have to be approved by the camera before they are implemented. The fines for not doing this are quite lucrative for the camera. 8 years ago we were fined more than 300 euros for not putting a step which was in the plans for the terracing around our pool. We argued that it was safer without the step and were allowed to leave it level, but at a cost to us. It could be the fines that are the sticking point. |

Thank you Carwyn.To add to our problems,we received today a second and final notice to claim in Labaro's Administration,specifying the exact sum of our investment.Despite Duja's claim in June that the Portuguese properties were outside the remit of the Administration proceedings,the Administrators in Madrid do not agree!
We would advise anyone about to complete to check that Duja can actually deliver on their promises, from a reliable source. The Managing director at YPA today knew nothing of the continued involvement of Administrators,and admitted he had not seen any of the promised Bank Guarantees. A warning that before parting with any more money.Check and double check. As for those of us still seeking to rely on investor contracts,it is significant that YPA is not marketing any Cabanas Golf Apartments on its website. Best of luck for the future. |

Have just joined today and, as many others, am concerned about our investment in Golf 2. completion by now nearly 2 years overdue and am seriously considering seeking refund.
Have talked to our portugese lawyer and he stated that although we had a strong case, actually getting our money back would be difficult. Caught between a rock and a hard place as our primary intentions with investing was to flip, not purchase Any advice out there? |

Hopefully, as stated in our contract, our deposits are held in the bank (BES), hopefully it shouldnt be too difficult to get it back as our contracts state the completion date should have been December 2006, give or take 5 months!!!!!!!!!

No letter from Duja as yet.Is your copy of the contract in Spanish the one which you have had to hand since you signed it in 2005/06? or have you recently requested it?I would be very surprised if Duja could have so accurately predicted a specific month for completion at that stage,they haven't even got the year correct according to many people on this site!I may be cynical,but I take nothing at face value now.

Now what i dont know is when we received the spanish contract. I best not put the whole letter from duja on this forum, but the general content is, duja entertained the idea of going into partnership with the labaro group "some months ago" but no payments was forthcoming so the business relationship was ended. So the letters do not affect nothing (dujas words) Duja also confirm in the letter that the apartments in Beach 1, as all the moradias in Golf 1,2 and 3 are finished and with the habitation licence issued so that they can be completed from now onwards. Finally, the apartments in Golf 2 and 3 are finished and the habitation licence has been asked for and will be granted once some aspects of the external painting has been modified and this should all be completed from the 1st December. If anyone would like a copy of the letter please send me a private message. |

I have bought a 2 bed apt in Golf Phase two,had what I thought was a signed bank guarantee,faxed it to sol in Spain,was told it was only a receipt for the deposit and despite stating on the signed contract there was a bank guarantee Duja never had these in place and in any case would be worthless because place has been completed.I was told it would be a long and costly process to try and get deposit back,seems we do not have a choice.Can we not get enough bodies together to agree a plan of action and all not complete until we get a price reduction to reflect the current market and lack of mortgage funding??

This is certainly an option to consider - would be interested in entering such negotiations should all else fail.
But still prefer to end the purchase process altogether. Has anybody taken further legal advice in this respect? Have contacted John Hughes - he is asking for £100 before parting with any info - does anybody know more about who he is? |
