We are waiting on Golf Phase 2.The apartments themselves were ready in May.Since then Duja have been waiting for Tavira Town Hall to issue the Habitation Licence.The response from Duja since May is always a few more weeks.They are still saying that.

I sent an e mail last week to Tavira Town Hall asking about the delay.The Mayor kindly phoned me yesterday.He says if Duja want the licence then they must finish all of the work.He also said that "they changed the project"..so for some reason Duja made changes that they were not supposed to.For some reason the exterior colours changed on phase 2 & 3 to what was approved on Phase 1.Why change from something that has been approved as okay ? ? If they can do that then obviously can also change other things that were accepted as ok.

I know that there have been slight changes to the interiors on phase 2..but nothing that I would have thought would cause them not to issue the licence.
Duja obviously want this licence as it is costing them a lot of money.

The apartments,gardens,pools look great..and I'm told that the roads and signposts are all done.I was there in June and there were no workmen on phase 2 or 3....looked the complete package to me.

They have had inspections but for some reason they cannot get everything done to the Town Halls satisfaction..each inspection must raise new issues.If Duja did not think they had put things right why go ahead with another inspection when they knew they would not be successful.I can only presume that new problems are found on each inspection...if so that should NOT be happening

As this has been going on since May...and Duja presumably know exactly what they need to do and want this licence so why have they not been able to complete the work to the satisfaction of the Town Hall ?

I get suspicious when things cannot move forward and have an open mind as to whether the problem is with Duja or the Town Hall.

There are a lot of bad builders and Town Halls in Spain and feel sure that Portugal are not affected by bribes/corruption/blackmail..but we all know that it has happened in Spain and there are a few dishonest people in prison as a result.

I have reached the stage where I don't care if I upset people.My mortgage with Barclays has expired and I have had to provide new documentation.I now have to have a 17 year mortgage instead of 18 years because of the delays.I visited in June and had to rent on phase 1.We are there in October and having to rent again on Phase 1.....all the time when we know our apartment is all ready to move in to.

If anybody using this site wants to raise their own issues the website for the Tavira Town Hall is below and contains e mail addresses..I sent mine to the lot and the Mayor responded.I sent mine in Portuguese by using a translation website...search on google for "babelfish".Good website but you need to translate back to english to make sure comes out ok....otherwise ends up very unreadable

If a few entries are made by people in the same waiting situation as me I will send a link to this website to both Duja and Tavira Town Hall to see if they will explain to all those affected exactly what the issues are and why they cannot be resolved. If people put theirs views and questions here you never know me might start getting answers

We are in the same position as you only we've bought on Cabanas Beach 1. It should have been ready in summer we had to rent 3 weeks somewhere, again in October it doesn't look as tho' it will be ready so we have rented again. The way we are looking at it now is that we hope when the licence does come thro' we can delay as long possible our side because the rental potential for this season has passed and the longer we can delay there will no mortgage payments to be made, and also it is cheaper to rent than pay the mortgage. Although because we were led to believe, by Duja, that it would be ready in the summer we have furnished the apartment and that money would have been better gaining interest in the bank!!! We were desperate for the licence to be issued a few months ago, no so now!!!

We bought on phase 1 nearly three years ago and have been told by Your Place Abroad the money would be in our account by 22nd September 2008- a year after we were origionally told,however cannot contact them - they are not returning calls!!! anyone else heard anything?

Is that the deposit you paid 3 years ago??? Or stage payments you are trying to get back due to breach of contract?

Hi Just wondered wether you have made any progress? We are in a similar situation to you in that we expected 2 Golf Phase 2 properties to be completed in December 2006! I have read a number of posts about the potential to pursue Duja for return of deposits, but just wondered whether any memebers were working together on this and were hopeful of making any progress:confused:

We received this email from Celia who works for Duja in the Tavira office. Wait and see shall we!!!!

"Finally we are going to start completing on Beach 1. Golf 2, hopefully, in two to three weeks and Golf 3 probably one month more.

I met celia 2 weeks ago and she told me the same story! I was also told that it is personal between Duja and the town hall, which is no good for all of us at all. Another problem someone in Cabanas mentioned was that with the builders finishing in may is that all the warranties on white goods etc, along with any snagging problems will be almost out of date as you only get 12 months grace.
It is a real shame that all this has happened as it has taken the shine off it all,and with hindsight we would have bought eleswhere in Cabanas. Anyone had money back yet? Anyone taking a 4% guaranteed rental and mortgage, which i got told is no longer on offer !!!!

From your blog it sounds like Duja have at last got close to being granted a habitation licence from the city hall. This habitation licence now allows Duja to complete a sale and purchase contract with you. This could take another month (or more) before you actually sign the contract. The documents of the property then have to go to the land registry to be transferred into your name - make sure this happens and you have the documents in your possession. You need to check with your lawyer (hope you have an independent one other than the Duja lawyer) regarding the 12 month snagging period and the white goods guarantees. Get this in writing!!!

Just returned from Cabanas...did 15th-25th oct

Roads all finished and area looks great.No builders as all complete.
There was a meeting on the 23rd Oct between Duja and the Council...a major problem has been that Golf phase 2 & 3 were painted a different colour to phase 1.....they should all have been the same as phase 1.

Duja have now had to accept that they are going to have to re-paint both phase 2 & 3 and they are doing there best to get this started this week...and to use several companies so gets done asap.

Once this has been done they can have the Habitation Licence.
We are on phase 2 and have been told should take about 4 weeks.

Tourist Info:-We had a family holiday with 10 adults and 2 kids.The community football pitch a great plus for the kids.Pool warm enuf and weather,apart from one very cold and windy day,was excellent.
Need a cardi/jacket for nightime as gets a bit fresh.

Zoo Marine a great day out.Altura beach and Monte Gordo both great.

The resort itself was very quiet.There is one boat doing the crossings to the beach.....on the beach the only bar was closed..no lifeguard and about 20 loungers/parasols.

If you go October you won't find nightlife apart from Quasi's,the Irish bar next door and Polaks..and they were all quiet.The Jolly Sailor opens all winter for your info..no idea about the others.O'Monteiro restauarnt and Sports bar next door both open.

The feedback from the family was loved area but too quiet at night and definitely need a car to tour around.Fortunately lots of nearby places to visit and this side of the algarve is superb.The new shopping complex on outskirts of Tavira progressing well

The season here is mainly June to Sept...after that very quiet.Never been July/August but those months its apparently extremely busy

Great place for us but won't be everybody's cup of tea

Ceinwen, couldnt agree with you more. We have a deposit in place for a 2 bedroom apartment on Cabanas Golf. We were also given so many promises at the start i.e option to flip, guaranteed rental income etc. Also the completion date agreed is now way overdue, if we would have completed back then, we would have had a better mortgage offer & the chance of getting a chunk of our deposit back. If I would have known 2 years ago what I know now, I wouldn't have touched Cabanas Golf with a barge pole.

Thank you Carwyn.To add to our problems,we received today a second and final notice to claim in Labaro's Administration,specifying the exact sum of our investment.Despite Duja's claim in June that the Portuguese properties were outside the remit of the Administration proceedings,the Administrators in Madrid do not agree!
We would advise anyone about to complete to check that Duja can actually deliver on their promises, from a reliable source.
The Managing director at YPA today knew nothing of the continued involvement of Administrators,and admitted he had not seen any of the promised Bank Guarantees.
A warning that before parting with any more money.Check and double check.
As for those of us still seeking to rely on investor contracts,it is significant that YPA is not marketing any Cabanas Golf Apartments on its website. Best of luck for the future.
