Hiya, an OCI is on par with an Indian citizen so an OCI (and also PIO) can register property without a problem. However, you need to check the rules to find out whether an OCI can confer PIO status onto a spouse. It may or may not be possible, in which case only the OCI may be able to have the name on the sale deed. This is not something that I have looked into at all.

At the moment Indians on our complex have NOT been able to register the deeds in their names. That includes locals who have purchased from neighbours.

The spouse of an OCI can obtain PIO status but only the person with Indian ancestry can be an OCI.

afaik the [mis]rule is that the Registrars will not register deeds where either party is a foreign national not of Indian Origin.

Might be worth getting an opinion from two advocates and see how the information compares? I don't think they charge for a first time exploratory visit. At least I've approached a couple of different lawyers and didn't pay anything until we elected to go with one.

as i say my wife is oci but ovb it dont make much difference in goa from peoples advice, better start getting another dream from the sounds of it .Thank you for all your help guys

Surely the answer is as Mayrig has said for the person with OCI to buy the property in their name only.
(Agricultural land is excluded).

Also add the names of any children or other Indian origin person in order to prevent any problems with inheritance.
