1. Employer base nominations are too low. In Mar-Jun 2009 statistics of DIAC there were only 450 applicants.

2. There are not much CSL applicants. That is why these occupations are on CSL. There are 41 occupations in CSL. Primarily because many are 'Doctor" occupations which calls for passing AMC Exam. My brother is a doctor in Australia and he did the same. Secondly, there are engineering occupations which require submission to Competency Demonstration Report. I submitted one and it is very difficult to submit such huge report for qualification assessment.

3. The intersection of CSL with state sponsoring occupations is low. For example in case of Victoria (176 occupations) there are only 21 occupations which are on CSL which is 50% of actual CSL. As a result there would be too less applicants in priority 2 (CSL with SS). Additionally, states take around 10-12 weeks to sponsor applicants which is going to buy us more time at DIAC. In case of Tasmania which has the longest list of sponsoring has 33 occupations in common with CSL.

4. With new MODL coming up CSL is anyhow going to be slashed by end this year. This means that occupation which would be in new MODL would get priority. As in case of canada where they have 38 occupations in demand at the federal level.

5. Australian economy is showing progress in the positive direction. this means fewer restrictions in next year.

6. Priority 3 (CSL with family sponsor) is obviously for those who have blood relatives in Australia. These applicants are by nature going to be low.

7. Priority 4 is CSL with no SS would again be low as the nature of occupations are naturally low. Around 50% of these occupations are medical related(Doctors, Dentist, Psychatrist, Pharmacy, Nurses etc) which have many intrinsic checks on them. Seven occupations are engineering related (17%) which requires CDR submission. Two (4%) are aircraft related which again requires CAA or FAA licensing. Very few trade occupations.

8. Prior to 23 Sep, 2009, CSL occupations (without SS) were also being processed. I personally know many on forums. In one case they gave 175 visa to an applicant on CSL depite of the fact that he had SS. Hence they are going to process MODL occupations (especially those who had been asked to do medicals) along with CSL cases.

Conclusion: In my opinion there is going to be a delay of at the most 2 to 3 months for those who have SS. The real change is around early next year. Where they are going to review MODL and identify federal shortage list applicable in entire Aus and slash CSL. This is going to be in line with Canadian immigration program where there are 38 occupations recognized federally. Aussies are copy cat and they changed themselves fast like after Canada announced 38 occupation last year.

Regards,
Bilal

I suspect/ hope you are right, currently under pressure to buy a new bigger house as wife doesn't want to put life on hold for 3 years! can't say I blame her really, just concerned about the official time line of end of 2012 (really means 2013) for applications lodged in 2009??!!??

The current estimate for the onshore skilled applicant is that it is "unlikely to be finalised" before end of 2011.

This is the response I got from DIAC through my consultant:
Dear Sir/Madam,

In response to your recent eMail and query regarding the 176 Sponsored
application for _________, I advise that it seems that the further
processing of this visa application is affected by changes to the
Migration Program as announced on 23 September 2009. These changes are detailed
on our website at -

http://www.immi.gov.au/skilled/gener...hats-new.htm#a
and at
http://www.immi.gov.au/skilled/gener...df/program-cha
nges-faq.pdf\

The ASPC is developing procedures to process applications in accordance
with the new Government Direction that has been announced effective 23
September. CSL cases will be given the highest priority and that is
where
the ASPC will be focussing its attention. Once the ASPC has established
processing arrangements for CSL cases, we will be in a position to
provide further advice, which, hopefully can be done by the end of October 2009.

If medicals have not been carried out it is advisable to wait for
further instructions before adhering to this requirement as they are only valid
for 12 months.

Please do not reply to this email address. Any further enquiries can be
made via our website

Yours sincerely,

Regards,
Bilal

Q14 What are my options if my application is unlikely to be finalised by 2012 and I applied for an offshore visa?
The options available are:
• to continue to await a decision on your visa application,
• consider your eligibility for an employer sponsored visa, or
• to withdraw your application.
So, we paid £1600 all in for everything involved in the 175 process, spent 6 months doing all the work involved with RPL, IELTS, references, police checks etc. Lost my job because I had to get a reference from work for the visa. Had families disown us because we wanted to move to Oz and FOR WHAT?

Wish we'd never come out on a Working Holiday Visa now to check the country out for 12 months. Been trying to find work but no companies seem interested in sponsoring 457s so far so basically no hope of staying at this rate.

2012!!! Could have applied to move to Canada quicker than this crap, and whats to say in 2012 immigration don't change the rules again and say 2015.

Its all a bloody scam this immigration lark. If I could get my money back I would, but NO. Immigration can change the rules all the time and happily take the money of people who put time and effort to come and live and work in a country.

I should have just become a bloody illegal immigrant. They have the right attitude! No money, get in the next day.

Stuff you Australia! Biggest mistake I ever made trying to do the decent thing and immigrate properly.

What IT specialism did you get RPL assessment for? You do know if its on the CSL (i.e. any 2231-79 other than nec) you are still currently able to get priority?

Hi AndyR

I completely understand your frustration.
When we applied in Oct 08 (i believe you are in the same timeframe), we researched the timelines and the process at the time was roughly 6-12 months. For ourselves we thought this was completely ideal and therefore went ahead with the process and lodged our application.

Its so disheartening to find out after a year that this could take years, especially as you plan your life around the move and like you said tell employers, family, friends etc... Not only that, but if you have children they may not be eligible the time they decide to process the application as they're too old.

Everyone has their own reasons for wanting to live in Australia, but this has really put a dampener on things.
I hope the new MODL changes are going to be released sometime soon, as then we can decide once and for all what would be best for our family.

Lora,

Man I never thought about the whole age thing with children and the delays in the processing. Just another worry isn't it!

Yeah we are Oct 2008 as well and planned the whole 12 months around that like you said as well so I totally understand.

We are in Oz at the moment and have been getting disheartended with the job prospects as well, more so when it starts to become more and more apparent we might (now definately) need 457 sponsorship to stay.

We'll have to look at our plans seriously now. Be it either sticking it out to find a 457 here, or instead jump to New Zealand or even Cananda. Just don't know anymore

Sending you some Karma anyway

i am with you mate on this. this waiting is bloody sickening. some days back i had seen the illegal immigrant story on the tv and now that sounds even more appealing than what we did. if i am not wrong i think there was a talk of granting them citizenship some time back! in fact i think thats the last file that john howard signed before he was kicked out!

we have just been reduced to a bunch of morons clutching at hopeless straws thrown at us once in a while by the Oz govt. we have been reduced to hoping and praying like a group of zealots who dont have any skills whatsoever.

like someone said, we are just file numbers for the Oz govt. so treat us like that- i.e. with no respect, no dignity and no emotions.

Psst- does anyone know of any illegal boat service which might take us to the promised land?
