Well I'm not going to get all negative about this BUT we've all gone over the limit but dont come on here suggesting that symphathy is wanted.The limits are there for a reason, its only 'smart' if your clever or lucky enough to get away with it.But what would you think if you hurt or killed someone through your actions.(This is not aimed at you 'ironpoer')This is generalisation.If you got caught, you only have yourself to blame,which means you are a poor driver at that moment in time !. Which bit?

A cop can commute almost any moving traffic violation to a misdemeanour if they want to. Driving with excess speed can be commuted to reckless without much difficulty (which is a misdemeanour).

And if theres any damage (to anything, even clipping a curb) then its even easier to do so.

Im sure you're aware of the law regards commiting any misdemeanour in possession of a firearm?

No. If you mean someone who is federally banned from posessing a firearm (convicted felon etc) then the mere act of possession of the firearm is a felony.

Even someone who is entitled to posess a firearm and who commits a misdemeanour while in posession runs the risk of being charged with a felony.

No, thats regarding the reclassifying of a felony crime if the perpetrator carries or uses a firearm and the firearm isnt an essential element of the original charge if I remember. Offhand I cant remember the statute regarding misdemeanours....I'll have to look it up.

In theory yes. In practice probably not unless you really really piss off the cop. But the upshot is that when you are in posession of a firearm you should modify your behaviour according to the added responsibility that goes with it.

That's like saying if I punch someone in the face on my doorstep I can be charged with a felony if I have a gun upstairs in a drawer.

No. The firearm is not in your immediately accessable posession.

However with it safely tucked into a holster or otherwise about or near your person it is.

Its all theory anyway...and highly unlikely to happen unless you piss off the cop or do something really stupid.
