Hope this helps anyone in the above situation, and of course the lawyer is obligated to return any outstanding money, if you fit into this situation - if so theres no harm in asking surely?

Hi Dave you mentioned before that you were seeing your lawyer face to face - good luck with that, there might just be a nice amount coming - I hope so anyway.

to anybody else reading this, that's why my last post was full of caveats, see above. I don't have any expertise here and certainly don't know if this works for everybody. But already we've had a post from Veleta saying the refund was over a thousand, in her case she had a good lawyer that settled up, and all she had to do was keep an 'eagle eye' on the bank account. Also the people I know that chased it (myself included) have had refunds in several hundreds of euro's if not over a thousand - that's for an appartment.

If it's standard practice to overestimate the charges (and I don't disagree with it) then the lawyer should of course settle up after completion, but if he hasn't and sadly, if one has to chase them all over the place, it may still be worth all the hassle - in the end. I personally couldn't let it slip, and would always expect to see a proper accounting for any business transaction. Nor is it in my character to let someone get away with delaying - or worse - not settling up an overcharge.

So I for one think its worth going for, if anyone is in the specific case in my earlier post (above).

Anyway I think Ive posted enough about this, this post has all the relevant posts included in one place - so Ill duck out of this in the hope that some people have been helped

Nice one Jag. You notice I didn't question the first post, as I know what they can be like!!

Once they get on that stuff they can be a bit of a handful, especially the "mate". Consider yourself lucky and glad they behaved themselves. I'd hate for you to bar me based on their druken actions.

Hey, just got back and had fab time, weather could have been better but what the heck. Back in July again so Jag make sure you replenish that Southern Comfort!! Food was great by the way.

On another note, noticed a lot of activity on the empty apartments in Rago 1 yesterday, in our block and the one across the way, they were all being cleaned. Wonder what this means!! And some of the renters appeared to have moved out or in process of doing so.

I take it you did know the bank (BBVA I believe) had taken all unsold ones in blocks 10 to 16 from Fadesa.

Looks like you may be getting integrated into the Spanish way of life pretty soon then, just hope it`s not cheap holiday lets from Madrid, like the Sun`s 5 quid holidays. ;-))

Could well be related. I wonder where that leaves the Fedesa Tenants now that the bank have taken over the ownership. Patricia (one of the tenants) in our block is a lovely lady. I'd hate to see her kicked out as she waters my plants.

Hi all

Re. Jon-BXL post about refunds, we had a refund but I didn't want to post until I checked the details and understand Jon's concern about raising false hopes, however awful to miss out if you are rightly due a return so it is worth checking. Good on you Jon for posting about it !

I did have to push our solicitors, I am sure our account would have been credited but at a much later date if I had not pressurised.

Our circumstances were that we cancelled the existing Fadesa mortage on the property and took one out with another provider. We had to pay to do this in the first place and I have to say the circumstances surrounding this were not made clear.

Our refund was:-

Notary 425
Land Registry 216
Management Fees 244

End of Work 360

Total €1245 credited to our account 5 months after completion.

Hope this helps anybody else in the same situation.

Yipeeee!!!!! yes you hear correctly that after 5yrs and 6mths we have a Boleten, Licence de Obras and legal electrikary And the Lord said on Wednesday 13th let there be electricity and there was and the solar pump ran and the hair dryer dried and the kettle boiled (and there was tea) and the aircon cooled and there was LIGHT EVERYWHERE, until 16.00 when the solar pump ran its bearings and the water cooled until 09.00 on the 14th when the lords helper fixed that.

The poor old genny is to be retired to that wonderful place that old gennies go to.
