When it became clear that the government were not going to step in and help (a la Northern Rock; FreddieMac etc...) they took the business decision to go into VOLUNTARY administration.

The Centro Comercial is full steam ahead - deposits paid are not even held by Fadesa, they are held by the Junta.

Properties yet to complete - ACCORDING TO THIS CONTACT, AND MAYBE NOT THE OFFICIAL LINE (because that is not their department) - will not lose their deposits at all. Esuri is an asset and they do not want it devalued in any way hence it will be completed. Should point out as well that as far as I'm aware, Fadesa have completed pretty much what they had to. There are sections which were sold en bloc to other developers - and that, for me, would be a worry, because if said developer were to go under, I doubt they would have the resources to salvage the situation.

In short, according to the contact, the suspension de pagos voluntario is a way to restructure without the crippling debt dragging them down.

BTW spare a thought for this contact as they do not know whether they have a job to come back to tomorrow.
It seems to be a cross between Administration (UK) and chapter 11 (USA) - both of which protect the company from creditors while they trade the company out of the financial mess. Tradng while insolvent is a criminal offence - trading under protection is not (UK).

Spain is different - but the company still exists, and it can trade its way out by honouring its committments. Talk of creditors - pence in the £ as in a bankruptcy are incorrect - at least at this stage. I expect someone to come knocking soon for the final payment on the plot in order to complete. However, it looks like when we complete we will have to sit on it for a while (understatement). Lose your initial deposit money - or pay £55K balance for a front line plot on a golf course...hmmm...easy decision in my book. Cash is king at the moment - and they want cash!

Hi thought I would just lighten the mood and tell you about a 2 year mystery that has still not been fully solved.
In September 2006, we had stocked our kitchen cupboard with essential items, 1 of which was Heinz Tomato Ketchup.
On our next visit we noticed that the items in the cupboard had been moved and the ketchup was missing.
Fast forward to July 2008 and we are next door meeting our new neighbours, Charles and Julia, for the 1st time. Julia just happens to mention that on their arrival they have found,in a kitchen cupboard, an unopened (well past its sell-by date) bottle of, you've quessed it ,Heinz Tomato Ketchup. So who is the condiment thief? Why was the bottle unopened? How did it get next door? Is this an isolated incident or have any other Esurians noticed condiments missing from their cupboards?
Regards Bryony

Yes had the locks changed straight after the ketchup incident as we were worried the HP Sauce might be next. Definitely in the right house unless the numbers have been switched around.

Does - or did - Fadesa retain a set of keys for snagging? Could be a hungry workman taking lunch with him.

I know of other similar spooky events in Isla Canela where sheets moved from 1 villa to another, unknown dirty towels appeared in a villa, sky cards got moved, etc.. It was never possible to prove but it was strongly suspected that the managing agents who had keys to the properties involved, were preparing the places for visitors, hadn't got clean sheets etc. and as a quick fix moved items from one to another and then forgot to move them back. And they weren't rental properties per se, just properties which were used by different owners and their friends.
Other tricks you can see going on are dirty sheets and towels being brought by an agent into a property, presumably to use their washing machine and free powder and electricity, and then being taken away a day later. I'm sure a CCTV could tell a fascinating tale.

Why offensive ?
Obviously you have not tried to fix anything to a wall or ceiling in Spain, or are you a bricklayer that builds 20 cmtr walls 2.5 mtrs high and hopes no one will lean on it too hard and make a quick exit to the next room.
