Re: Aussie Incoming Passenger Card and TB

So does someone with LTBI have TB? They have inactive TB bacteria in them. The question on the card really isn't specific enough. I have been treated for a latent TB infection. I will take it to mean...

Aussie Incoming Passenger Card and TB

The incoming passenger card asks "Do you have tuberculosis?" Should I answer yes or no if I have been treated for latent TB infection (LTBI)? My initial thought was to select "no" and write "treated...

Re: Taxation of Occupational Pension

I think the distinction might be that MOD or Local Government etc employees are employed directly by a governmental organization. However, although the NHS is funded by the Department of Health it is...

Re: Which passport to use ?

I always use the passport of the country I'm either leaving or entering. So leave US on US passport and enter the UK on UK passport. This has only ever been questioned once when I left the UK and...

Re: Women and Pensions plus government gateway

Yes, the break even point is around 80 ie the average lifespan.

I've been an expat for over 30 years and I had no difficulty signing up to the UK Government gateway, but with these systems there...

Re: Pensions and PFICs

There is a view that SIPPs and personal pensions that don't get employer contributions are not pensions under the treaty so are treated like ISAs ie the tax free wrapper is invisible to the IRS. But...

Re: Moving from UK to Atlanta

A long wait for a visa is probably disappointing, but you can use the time to plan you move and avoid the mistakes many people make.

1) You should look into health insurance. Moving to GA I don't...

Re: Pensions and PFICs

Money inside recognized UK pension wrappers is protected from US tax until withdrawals are made and they are taxed as income by the IRS and/or the UK according to domestic laws and the DT Treaty....

Re: Moving from UK to Atlanta

Hi there. Just for clarity is there any chance that you are already a US citizen because of your parents US citizenship?

Re: Uk House dilemma - sell and buy a smaller buy to let?

Any income or gain from assets you have outside of UK pension wrappers is going to be taxable by the IRS when you become a US resident. So you are doing the right thing selling your home before...

Re: Do some US tech companies provide health insurance for the whole family.

Will your daughter be working for an Australian branch of the US tech company? If not then questions about employment law and taxes will arise.
It sounds like there might have been two mistakes...

Re: Do some US tech companies provide health insurance for the whole family.

I would be amazed at any company health insurance package covering the parents of the primary insured person. Family plans usually mean a couple or single parent and their children. US health...

Re: UK Final salary pension transfer

If a SIPP qualifies as a pension fund under the DT Treaty then there are no PFIC issues as the tax wrapper protects the funds inside from US taxation until income is taken and then only income tax is...

Re: UK Based Pension

I just want to clarify that a UK employee pension funded with income that was not subject to FICA tax cannot be reduced in anyway by the IRS. It will be used to calculate the level of WEP reduction...

Re: UK Based Pension

For StatePension/SS the top up payments are only used so that you can qualify for a benefit, not in it's calculation. As you have more than 10 years of SS payments it's of no use to you. FYI there...

Re: UK Based Pension

As you are a US resident you will be taxed just like a US citizen. Be careful reading HMRC advice as they are not the IRS.

If a US citizen or US resident receives a lump sum distribution from a UK...

Re: UK Based Pension

Yes that letter points out the US tax problem with cross border transfers. It is non comital on the actual status of a SIPP as far as the IRS is concerned.

Re: UK Based Pension

Yes, sorry I was thinking of QROPS, if the transfer takes place between two pension funds within the same country there should be no taxable event. However, if the transfer is across a border then it...

Re: UK Based Pension

I'd be careful doing a cross border transfer of the SIPP to make sure that it has no US tax implications n.b. it almost certainly does. You will need to take experienced and impartial international...

Re: UK Based Pension

Tax residency is going to be the issue, not where you spend the money. Presumably you will arrange things so your Green Card is not in danger and so will limit your time in the UK. As a Green Card...

Re: 25% UK pension tax free element

The strategy to avoid having the 25% UK tax free amount taxed in the US is to make sure it is shown as income from a pension and not a lump sum distribution. By doing that it falls under Article 17.1...

Re: 25% UK pension tax free element

If you are a US tax resident any UK pension payments are going to have to be declared to the IRS...so if you take the single 25% payment many people feel that you will have to pay US tax on all of...
