A person will not pass the character test where:

they have a substantial criminal record
they have been convicted of any offence that was committed while in immigration...

You are asking the wrong question. An application can be lodged, but be invalid.

If you used the correct forms, lodged in the correct place and manner, the visa applicant was in the correct place...

There is no requirement to prove cohabitation for 12 months, or any other period. The requirement is to be in a 'spousal relationship' for at least the 12 months immediately preceding a visa...
