Oh Polly the strangest things are said in jest. My eldest daughter is now madly in love with a guy who has been round Oz backpacking and his ambition is to go and live there

I agree. I think the worst thing to do when you are feeling vulnerable is to start looking for a new love. Far better to concentrate on yourself and finding new friends and hobbies and in time the right person should come along.

I feel it is important to alert Megansmum to some serious misinformation fed to her here.
It is highly unlikely that the Family Court of Australia will "come after" the mother of a child who has returned to the UK with her child-both being recent immigrants.
The rather silly assumption that being Australians the Judges will tend to want the kid to stay in Australia is bunk.
It would be extremely foolish and expensive for your hubby to embark on a dishonest case to prove the kid would be better of with him.
Who will he claim will look after the kid when he works-can he afford a full time nanny??
Judges arent that screwy or stupid.

Normally child custody law is based on where the child is resident. So if parents move from UK to Australia and then separate, then the Australian courts usually have jurisdiction.

If a parent takes a child back to the UK without permission of the other parent, they can find themselves served with a court order insisting that child be returned to Australia for a custody and residence determination.

The grey area comes about if child is taken back to the UK with implicit consent (or at least, no active objection) from the other parent. And then subsequently, (ie months or years later) the other parent changes mind and wants the child returned.

It may be that in those circumstances, where child was brought to the UK with knowledge of other parent, the UK courts would not then insist the child be returned to Australia years later. But you would need to validate this with an experienced UK family law solicitor (and one of the few who understands international child custody issues).

Bad advice-alerting the hubby will just give him ideas-take the kid and leave.
I have a lot of PROFFESIONAL experience in this very matter-take the kid and just go.
The family court generally has a massive massive tendency to believe kids fundamentally should be with the mother-and will only act contrary to this in extreme circumstances.

TBH as much as i value the advice etc, i know in my heart that he wont stop me taking her. He still has one child here & that will be hard enough for him

I have asked he does a letter anyway but i cant see either how i could be stopped as we are not PR's or citizens & have only been here a short while

Anyway whatever the if's & buts, I do trust my husband to let us go

As you all know,I hate it here & have been unable to settle for a long time. Its caused immense strain on our marriage, to the point where we have argued continually

Anyway after some very long painful thinking & talking ive decided to leave. Si still adamant he iisnt coming with me as he wants to stay so its just me & megy

I feel terrible for taking her from him but i cant carry on being unhappy any longer as it was affecting her & Karl

Ive spoke to my family & they will be sorting out some airfare for me in the next few days

I plan to fly back around the 8th July as have some things still needing doing here. When i do return i will stay with mum for a bit then i intend to try & make my home in newcastle near my sister

Ive also been in touch with the benefits office & have been told i will get help so i feel quite relieved that i wont be completely skint!

Its a very sad situation for all concerned but its for the best in the long run!

Hi there,
Well i'm am so glad to have found you. I have been feeling the same way living here in Mackay,We have been here for a little less than a year and i hate it, my hub on the other hand loves it here and so looks like i may well be taking myself and my three kids back on my own, as soon as we can sort it. I was never really that keen on coming here in the first place and wish i had listened to my heart and not come. But i do feel i have made the right choice in returning home now that i have seen your post which seem to reflect exacly how i feel.
