Oh ok, Does this apply to common-law sponsorship? I have a question for you.. Come may/june time I will be eligible to apply for common-law sponsorship.. I have just applied for the IEC for my second time, but have my doubts and fear i am going to be rejected.. If worst comes to worse and I am rejected - will I still be able to apply for my common-law and wait for the approval in the UK? Will it have a negative effect because I am not currently with my girlfriend even though we have been living together for 1 year previously...

I hope this doesn't sound too confusing, I am not always good at explaining my situation lol.

If you are separated (i.e. not living together) at the time of application, you are no longer common/law. Short 2/3 weeks separation is usually fine, but anything longer it starts to become very iffy.

Really? So how am I supposed to apply if I don't get a working visa? Would it be the same situation if we were married?

Why would you not get your second year IEC? We are also applying for our second year IEC VISA while awaiting our PR VISA.

CIC doesn't care. You could remain as a visitor to continue the common/law. No, if you are married, you are married.

PMM's right, it maybe harsh but since you can legitimately extend your visitor status, there is no real reason as to why you can't complete the year living together as common-law. CIC will not accept that because you can't work, that you therefore can't live together. Their argument would be that if you are in a common-law relationship then the Canadian citizen/PR should be willing to financially support you through this.

But on the CIC website it says that after a year of not living together you are no longer common law, not after a month.
Would it make a difference if you were also engaged?

I noticed that on the website also, If I get rejected for my temp work visa, i will have to get a visitor status and apply for common-law that way. That seems like my solution. the only thing that sucks is I will most likely loose my job which I love. Or we get married and I still loose my job, I wish LMO weren't so difficult!

Right, everynight I say to my husband I will not check CIC website till at least February, but I can't seem to stop myself from checking at least 3x per day.

Ohhh I thought you'd heard something then 123me

Same as us it can't be helped, saying that we are not doing it as often as we are packing to go over to Canada at the moment, it would be good to sort it before we go though
