This was my thoughts exactly,did you notice the mention of him being on a tourist visa,where in FEMA does it say anything about visas??

It would be interesting to find out exactly what was his "crime".
Was it because he hadn't done his time before he bought?
Was it because he hadn't channelled the money through the RBI?
Was he now on a B or T visa to run his apartments?

At 4 Lakh can I buy it? I'll even pay his fine.

When we went to see the D of E 2 years ago we were told (of course he didnt want to put it in writing) that we could work on a 5 year X visa !!!!
and when we went to see Anupann Debt Management he told us that you can only buy on an X visa or buisness or employment. he said it was illegal to buy on any tourist visa, :eek::eek:

I had a talk with this couple. The property is not cofiscated and the article in the newspaper is wrong. This is allready the second time that the DofE try to confiscate that property. First time the fine was several times higher and they fight against the complain. The complain says that they did'nt ask for a permission from the RBI because they bought the property on a 1 year tourist visa. All was whithin the law of FEMA.

this is all beyond belief really, situations are so different to understand, we were told in 2002 by our advocate that under no circumstances could we buy on any form of tourist visa, hence we got employment ones.
I would like just an answer to one simple question those of us who have been investigated and heard nothing does that mean we are ok 2 and a half years is to long for an answer and surely if we guilty of anything they would have contacted us by now.... prehaps we need to start a campaign to the D of E now,, get some answers from them

It should be possible to get the "right of information act"? I'm in the same situation, no info from the DofE since more than one year. Do enybody knows what to do to get this information?

Hi naranala,
You can't actually apply for this information if you are an FN but your advocate can do this on your behalf

It's quite simple to request info - ALTHOUGH you need to be an Indian citizen to be able to apply (although I've received things and I'm not - as with most act's most people/govt staff don't know all the 'in's and out's'

The request needs to be as specific as possible, dates, file numbers etc, You can also inspect files also and then mark items you want copies of. You can list several items but I wouldn't do too many at one time..

Before handing in your letter be sure to affix 10 Rs/- of court stamps to it (there's a 10 Rs/- charge - court stamps are easiest). Photo copy it and make them sign as being received.

They then have 30 days to give you the info... Although it's never that easy.. I have a few pending, if they delay you can request compensation of 250 Rs a day for lack of giving the information, but this you need to appeal for within 30 days of the first application's time limit ending...

It was a flippant comment - obviously wit is in short supply here.

It was just the way that the newspaper reported it that property valued at 4Lakh had been confiscated
