Your telling me, as as of today im 11 months waiting. Never did I think it would take this long. My last visa (waiver) ended a 12 months ago, we thought get it in process straight away. Processing time approx 9 months, oh we will be sorted and booking for October flights, now ive got no idea when or if we can go. Can't even rely on the "submit your passport for visa issuance " email as there is no guarantee its approved.

Hi, Just wondering if anyone has received a letter like this?
Applied 6th Sept 2024 and just received this now.
It does not quite say unable to receive waiver for ineligability but seems like a letter not approving.
Has anyone else received this letter? I am finding it a bit confusing as to whether it is adviing refused the initial visa or the waiver of inelibility

debspo The main body of the letter is very much like the one issued at interview, that last paragraph though is the one that really says it all. I've moved house since my interview so doubt I'd get letter forwarded to me, will be interesting to see if you get an email as well, from my point of view.
Was it a b2 visa you applied for? also reads like it wasn't sent off to DHS, I'm sure there was a case a few months ago where it had gone off, come back and was reviewed again, for something similar, Jools may recall better than I.

We unfortunately have no way of knowing whether they have simply been sitting on the application in London in a form of Administrative Processing for the past year, and have only now decided to reject the application without making a recommendation for a waiver and sending it to the ARO, or if ARO did actually approve a waiver, but they have subsequently decided to refuse the visa anyway, which is within their right.
Again, you have our heartfelt support. Everyone currently waiting is on tenterhooks and yours is actually the first news from London in almost a month.

What is confusing me is the fact it does not mention the waiver of ineligibilty at the bottom??
The post on 25 June specifically says he could not be considered for a waiver of ineligibility.
Am I just grasping at straws?

214(b) is a catch all reason for denial which appears to be the default if they don't want to grant the visa, no matter how many ties you can demonstrate. And there is no appeal process.
There is nothing stopping you from trying again, but in the current political climate, it's unlikely you'll get a different result... and will of course still have the same wait if not rejected at the interview stage this time.

E-mail received from Consulate. It says I can try i212 form but ATM I think It will be waste of time, energy and money. Thanks for all support. I've been following this forum and wish you guys all the best.

Do note that Chiquinha is applying from Brazil and reasons may be very different from London - I212 is a specific case for overstay/removal I believe, so may not be applicable to most here. But timelines are still the same unfortunately.

Hello everyone.
my husbands interview was August 16,2024 and was recommended for a waiver. Today he received the same denial letter on email. Most of the body is the same. Just at the end it says they couldn’t recommend him for waiver at this time which is so unprofessional and seems to be rushed in writing. It’s devastating cuz we have a daughter together and I have spent all my life in America with family and all will be left behind…..
