Damn, I feel for you! hoping yours comes through soon. I am in a similar boat and the stress levels are high.
I left the US in may 2023 with 2 weeks worth of summer clothes to go to a wedding in the uk and renew my visa. There had been complications previously and I was assured by the lawyer processing my paperwork that there would be no issues this renewal. I am on a spouse visa so not even my own visa, my spouses visa was approved and I was recommended for a waiver. I have not been able to return since may 2023, I run business in the us, all my belongings are in my apartment, I have had serious financial loses, while still having around 2k in rent for my apartment and business premises to pay per month, This is my second waver and was told it would be approx 3 months, 9 months later I am still waiting. My partner has been back in the us since may 2023. I have been scrambling to find accommodation and enough work in the uk to help cover these costs.
Some folks are worried about a holiday 😅 I guess it's all relative.
Hope we get some updates soon and things start moving along again!

That is shocking!
I still don't understand why if you've been granted a visa previously, and you've had no further convictions, why it's the same process to wait for DHS. Surely if you've been granted a visa previously, the embassies should be able to grant them on site if that person has had no more run ins with the law?

my understanding is that I had a valid visa during that period, I traveled abroad several times and each time after confusion and further questioning from CBP agents I was admitted to the US. The lawyer who processed my mine and my spouses visa blames CBP for this "clerical error", although I blame her as it seems something was incorrectly filed on my arrival in 2020. Most frustrating part is I went through the waiver process in 2022 and was granted a waiver which took 6 months to approve. Apparently that waiver was only valid for 1 year which at no point was communicated to me by anyone, I learned this at my 2024 renewal interview. The lawyers assured me everything had been rectified and I would not encounter any further issues. They also claim the interviewing agent at the embassy in London could have approved my renewal on the spot avoiding this issue, although I think they are trying to cover their back.
TLDR: Turns out just because you are qualified and employed as an immigration attorney does not mean you are necessarily a competent one. If anyone can recommend any no win no fee better call Saul type lawyers I am planning to sue them for ruining my life twice in 2 years. If I ever make it back into the US...

Yeah me either, I have no convictions although due to a "clerical error" I was flagged as overstaying a visa for more than 2 years from 2020 - 2022 which resulted in a 10 year ban.

No, as with convictions and other bars, there is a waiver available for 2 and 10 year bans. The ban is not cancelled. The waiver is processed in exactly the same way as all other waivers. It doesn't matter the type of non-immigrant visa being requested, or the type of waiver, it all goes through the ARO in the same way.

Hi All
just wanted to mention that there also seems to be a delay with issuing visas on passports once approved. I sent my passport over 3 weeks ago now and Iv not heard anything.
Thought it be useful for people who have a time restriction and holidays booked
thanks

joolsjools Do you know when the processing time was updated on e-SAFE to 9 to 12 months?
Since when have they been estimating a processing time of 9 to 12 months?

Is anyone aware of any other forums focused on Nonimmigrant Visa Waivers of Ineligibility that share timelines? I’m particularly interested in forums from Canada.
The largest number of visitors to the U.S. comes from Canada, followed by Mexico and the UK. There are likely many Canadians applying for the same visa, so I would love to see notes and comments from those forums.
I'm at 315 days and loosing thousands of $$s per month, the waiting game is becoming very expensive...
