Re: Prince Harry "considering US Citizenship"

I guess he must have a greencard based on this article, but of course they could mean "tax resident"

Re: No bank account without address // Cannot rent without a bank account

Some cities/states(?) don't allow this anymore. For example in NYC: https://hcr.ny.gov/system/files/documents/2020/10/fact-sheet-09-10-2019.pdf

Re: Rishi Sunak held Green Card for 6 years as MP

He can do what Nick Clegg did and go and work at Facebook (probably EB-1)

Re: Rishi Sunak held Green Card for 6 years as MP

This implies he kept the card and travelled with it, right up to and including his first trip to the US as a Government representative (presumably with a diplomatic passport). Then he agreed to...

Re: Rishi Sunak held Green Card for 6 years as MP

I thought LPRs are always tax resident based on the GC test?

Re: Rishi Sunak held Green Card for 6 years as MP

I didn't think this was news, when he became chancellor he flew to Washington and tried to enter with his diplomatic passport. The CBP said sir you are an LPR, you can't enter the US as a foreign...

Re: Visas and passports

The US don't really stamp passports for ESTAs now.

Re: Class 2 NI. What about us poor expats paying voluntary contributions?

Maybe someone in a high place is good at lobbying for it :) But then again for the really wealthy it's small change (unlike say non-dom)

Re: Internal transfer visa vs new job visa

I'd get clarity on that ASAP considering your other offer

Re: Internal transfer visa vs new job visa

No issues - but you can't move L1 to a different employer.

For the other employer, what is the path they are offering? I'd be surprised if there was an other path available. If they say H-1B then...

Re: I-313 AP - Travelling abroad with L1 visa - lawyer charge $1000

Thanks for the update. I got my EAD last week but it is not a combo - only EAD. The lawyers at work said that was because I left (?). Nothing on both my I-131 applications, they are just sat there...

Re: Moving to LA in two weeks, would appreciate a sense check!

This is a huge red flag, you'll want to deal with this before you become US tax resident for sure. Search around here for PFIC rules and S&S ISAs.

Re: Car insurance

Thanks for the detailed reply. The irony of Car B being in the wrong and a cop is the worst part. I'd struggle to keep it cool with them when they were in the wrong (but getting annoyed with the cop...

Curious on the background for this - what exactly happened and what was the "offence"

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Small point, but you can totally have both. Lots of people have a Visa for a specific purpose and an ESTA at the same time. However, in this context yes the B1/B2 replaces the need for an ESTA, which...

Re: Prince Harry "considering US Citizenship"

Interesting side question, can Royal Family members live in Canada/Australia for as long as they want? Are they exempt from usual immigration controls even when not on state business?

Re: Prince Harry "considering US Citizenship"

I was thinking about this - it's not like he's been convicted. Does writing it in a book count as a legal admission of guilt?

Re: Transferring from Canadian office directly to Green Card via EB2/3

Are you already in the US or still in Canada?

There might be forward movement in the bulletin between now and October but it's not certain for sure. We had a big retrogression last year

Re: Prince Harry "considering US Citizenship"

I'm pretty sure he said in 2020 that he wasn't getting a greencard, but that might have changed I guess.

Re: Prince Harry "considering US Citizenship"

I vaguely remember that when he first moved they suggested he no longer had a diplomatic passport as he's not a 'working royal' - so not sure how he could have A status without that.

Re: Transferring from Canadian office directly to Green Card via EB2/3

Is your PD March/April 2023? If so you will most likely still have a wait before it becomes current for Final Action and perhaps even filing. The current FAD is September 2022. Possible it becomes...

Re: Rescinding my green card, exit tax?

Primary issues are around investments such as S&S ISAs which the IRS treats very poorly. Then again there are many USCs who live in the UK and deal with it just fine - something to consider though.

Re: Prince Harry "considering US Citizenship"

I seem to remember when he first moved there was a big song and dance that he wouldn't seek a green card and there was some debate over his status.

Isn't it true if he becomes a USC he loses his...

Prince Harry "considering US Citizenship"

Does that mean he has a green card now? Or has had one for 3 years?
