Hey ipom
Caught up with this and your other thread recently.
I too am sorry things are not going great at the moment...it might all seem doom and gloom right now, but I am sure at some point in the future it will all fit into place why this was not meant to be right now.
I hope you find what you are looking for........thinking of you.

Apparently it is 'inconceivable' that we would not complete, according to the vendor's solicitor and they are saying we have just 'changed our mind'... that the road plans (that they did not disclose) do not affect the property at all and that we have simply just 'changed our mind' ...
Therefore, they are seeking to force us to complete.
Given that they didn't have the money to attach their septic tank to the sewer, how are they going to afford to take us to court?
Our conveyancer is seeking advice from a property expert in Sydney this afternoon.
Uh huh.
This is going to be interesting.

Thanks. I think they're just going for the only straw they can grasp on to.
I'm quite happy to go to court.... They wouldn't stand a chance.

Sounds like they are trying to call your bluff. As soon as anybody sees the contract without any mention of the proposed work, then it will become obvious that they have failed to disclose really important information, pertinant to the sale of the house. It's not the same as not disclosing that you once fell out with the neighbours back in 1989.
If you're going to court, it would be worthwhile making some notes now (while it's all fresh in your head) about the exact nature of the transaction etc. Anything that can help to support your case is good.

Well bring it on, I say.
It won't get to court. They'd be better off putting their time and energy into lowering the house price and selling it to someone, rather than taking us to court for something they're obviously not going to win. That would be crazy and they need to think very carefully.
We have everything written in a file already... plus our conveyancer has all the legal stuff too.
It'll be ok. They're just posturing.

Thanks Chels. Yes, a bit tedious but they're obviously more stressed about it than we are.

Ok, well I'll be honest.
They're cheating, lying bastar*s who deserve everything they get. I hope they take us to court. I shall enjoy claiming all my expenses off them for the 3K we've lost in this process.
