Saying that, we went to see a GREAT house this afternoon - but the garden was too small. At this rate, we'll be back to building again....

Right, well we're pulling out.
We went up with our tape measure today and had a look at what would happen with a road upgrade and it would seriously impact on the property with noise and frequency of traffic, esp with increased traffic in 10 yrs time.
Though it 'might not' go ahead, the bottom line is that no-one can guarantee that it won't, and really, the bottom line is that we have to protect our investment for the future...
I am sad, but hey, it's just a house and it wasn't meant to be.
Better one waiting for us round the corner....

I'm glad you all made the right decision for you and your family and I know that somewhere not too far away there is a house with your name on it and a place waiting for heart in it.
I wouldn't really give the ppl a second thought, think personally they brought it on themselves, did you take the spray can to draw out the area it would hack off the land? If so I hope you left the marks there just to remind them.
Very desperate people to decided their going to withold info and lie to potential buyers.
On the up side at least you didn't get a broken heart over this property down after you'd bought it.

jsut caught up with this. sorry to hear that it has all fallen flat - but at least you knwo before you brought it and it turned from your dream home to a house from hell.

I have only just picked up on this thread. I am so sorry about the house, I know its only a house but females often make them more than that. I am sure something better is just around the corner.

Had no internet for a few days. Bummer you had to pull out but it is only a pile of wood and stuff even if it was put together nicely
Judging by what I saw when we were up there, there are stacks of fab houses around. No doubt at all you will find one that's right. Good luck.

I believe the conveyancer has put a retraction to our contract and this is why the shit hasn't hit the fan yet. She says that it could get nasty but not to worry.
I don't think they know where we live....

I thought it might be quite useful to put up the retraction letter... just in case anyone finds themselves in a similar position and wonders what to expect.
The agent rang today asking if the vendor could compensate us (ie - lower the price) of the property at all, but as we said, the RTA were going to compensate us for the land they were going to take anyway, so the sale was no go. The agent was very pleasant about it all.
Here's the letter:
Dear Sirs
Purchase of property, Gt Western Highway, Mt Vic etc.
WE refer to the above matter and advise that the purchaser rescinds the Agreement for Sale dated 25th January, 2007 due to the Roads and Traffic proposal which affects the property and which was not disclosed in the Contract. A copy of the proposal is attached to this letter.
The purchaser requires repayment of the amount of the deposit and all other monies paid pursuant to the Agreement without deduction and without prejudice to its rights to claim damages or compensation in respect of breaches by the vendor.
Please authorise the agent to refund the deposit paid to our client.
Yrs faithfully etc.

She's not a solicitor... she's a conveyancer, which probably explains why the letter makes sense.

The f***ers I'm buying my house off...
well for a start, they didn't declare that there was a council order for the 'new people' (us) to connect to the sewer within three months of buying. Fair enough, let's get a quote and they can pay half.
So we got a quote for $12k, to do said job. The vendors are going to pay $6,500 and we have this written in to the contract. In the meantime we find another quote, for $8K, and we could find another for less. That's fine, because the vendors are paying for most of it now, unbeknown to them.
This morning I get a letter which tells us that the highway is going to be widened right past the house. We were told there were no plans to widen the highway. Given the Heritiage listed nature of the house we're currently checking whether the plans still stand. They were made in 1970 and 1972.... It's possible the heritage listing came in after that and that the plans won't be allowed.
The plans state that they want to take an 8ft by 8ft corner of our block and pay us for doing so. That's fine, but it appears this will mean we'll have a 4 lane highway going past our house.
This was not disclosed to the vendor's solicitor, which now means that the vendors have twice broken the contract conditions...
I still love the house and the land but FFS! We are seriously considering asking for a massive price drop or backing out completely.
Any input gratefully received.

I agee cut and run, You could end up in my situation if you take it on.
