We had a similar situation arise a few months back. After waiting 2 years for LC to get through the back log, we found out that the lawyers were only working to the companies best interests and weren't listening to us at all. We had to remind them that we had paid half the fees and therefore they were working for us also.

We had a similar situation arise a few months back. What I meant was that the whole LC process should be the responsibility of the company - i.e. THEY should be paying for it.

I am not sure of the legal situation, but until I heard of your case and Lisa's, I had NEVER heard of a company not dealing with, and paying for, this part of the process. After all this is THE key component of the PR sponsorship process.

Our company were only willing to pay half the fees, and we had to pay the other half. Unfortunately the attorneys failed to see us as paying clients. So in March 05, after waiting a year for the LC and PERM just starting we asked if we should think of applying for PERM instead, we were ignored. So we waited an extra year for the old LC to be approved for no good reason. OH was filed as an EB2 which was current the entire time. :curse:
We're lucky that at least we now have our I-485's filed (since january) so will have to just keep waiting I guess. That'll teach me for thinking we were almost there.

If you filed in January it really shouldn't take much longer - I think 8-10 months is fairly typical!

Sounds familiar, the old waiting game, but we missed the new retrogression by 24 hours!

Feels like we had a winning lottery ticket but threw it away...

This was exactly what we had to do, the company was only willing to pay half and we paid the rest, actually we paid more as we used the fast track process NOT! thats why I want some of our money back as we paid extra for this and didn't receive it.

OH is in a very specialised field... BUT a job has just come up back in the UK
If we file in July he cannot travel for the interview...assuming he even gets one. If we don't file and he doesn't get one and there is retrogression in Oct.....we are damned if we do and damned if we don't. However even OH , who loves it here, is beginnig to be p***ed off with the whole thing.

Why can't he travel if you file? As long as his H1b is valid, no problem...

I say the same as Elvira, if your visas are still valid you can travel. We filed in January, but left the country in June for a trip home and got back in with our visas (which expire in November) no problem.

Well I thought that. But our lawyers say that once they have filed we cannot travel until either we get advance parole or our application is rejected. The rejection is the most likely of course but they do not know how long that will take.

I will ask tomorrow.
I have just got back from walking the dog and have spoken to two people here on H1B's who are about to throw in the towel and go home after what's happened.
