I received the magic email today to send my documents. Just posted on a next day delivery from Uk to Ireland ( with customs declaration ). I enclosed the page 2 with my passport as requested. They say 15 days to get it returned! I need to fly to Dublin to collect it.

What is the page 2 and what is customs declaration?

The instructions told me to print a document which had two pages, page 2 was to go with the passport to the embassy in the envelope.
the customs declaration was due to bloody Brexit and Ireland being part of the EU! Anyway it’s on its way. Should be Saturday or Monday latest. Then it’s a 15 day wait before I need to fly to Dublin to pick up my passport as they won’t send it to the UK from Dublin.

As per the FAM —

9 FAM 305.4-3(K) (U) Annotations for INA 212(d)(3)(A) Cases

(CT:VISA-2065; 09-11-2024)

(U) You must comply with all "Conditions of Waiver" noted by ARO in ARIS after an approved waiver decision is returned. Visas with approved waivers must be annotated with the "Grounds for waiver" information as it appears in ARIS (usually "212(d)(3)(A): [insert ineligibility waived]").

Google “Ina 212(a)” to find the grounds of inadmissibility. The grounds involving past criminal behavior are at 212(a)(2). Immigration misrepresentation is at 212(a)(6)(C).

The annotations often do not follow the formal formatting, eg 212A6C without the parenthèses and mis-capitalization.

BTW, the convention among immigration cognoscenti is to use Act citation rather than Code citation. INA 212 is codified at 8 USC 1182. That can be confusing at times. Also, acronyms can engender confusion. Act citations tends to be accurate and concise.

Getting slightly nervous as we have to pay the full balance of our April holiday this month and haven't had waiver email yet. Plus I've realised from your table that it can take up to a month to get the passport back once we send it. 😔 interview was April last year so still hoping we hear something in Jan.

I can imagine that you are getting a bit nervous. It's really tough to nail down an exact date when you will get the email. My case was started in Feb 27, 2024 and I had a back and forth with some documents etc. Which probably delayed the request for a waiver to the 25th of March 2024. I only heard back on this week on the 2nd of January. One thing is clear the waiver for the first time takes longer, approx 2 to 3 weeks more for some reason. It can't be too far away but you never know right. I guess the holiday will be non-refundable one you pay the deposit right? Maybe you can still postpone the dates?

Good luck. I know how frustrating it is.
