There is a big difference between a systems failure (e.g. automatic braking not working) and a design compromise (e.g. automatic braking not fitted).

Would we resolve a car driver of blame for rear-ending someone on the motorway because his car wasn't fitted with ABS?

Not at all ,the lack of ABS has no bearing.

But things have been going that way for years, blame the designer, manufacturer, the police chasing, not the guy with his foot on the acceletator, where blame should be put.

I presume you mean absolve

but the answer would be no - it isn't one of these new "proximity" detection systems it is an ABS, it is a system to control the brakes in such a manner to prevent wheel lock and skidding
it is only of use when the driver switches it on with the brake pedal, if he is late doing that you can't blame the ABS

presumably that was also the driver's fault for allowing it - but he will have had extenuating circumstances as she was accompanied by a middle manager who may have taken responsibility.
it is at times quite easy for a manager to bully a member of staff to allow this sort of thing. so if the driver refused and left the train he would still be at fault for the train not moving.

I would have thought that this sort of showing off would have been drummed out of the workplace by now.

But until then we will have to rely on the common sense of the drivers of the trains, not to act like boy racers who bomb along at inappropriate speed.
