Been to Denia. Will not issue residency certificate without proof of income documents (of which they could not tell me what documents they wished to see!)
Ive been resident since 2009 but my OH has been back and forth to UK until now. He cannot get proof of income as he does not currently have a job and they will not accept my contract/nominas as proof of income as we are not married. I have evidence we have been a living together 18 years and owned our home here for 8yrs but that is not good enough. i have a certificado conviciencia..thats not good enough! Apparantely I now need us to register as Pareja de Hecho and they MAY consider allowing him residency! My ajuntamiento does not 'have the book' to register. So now trying to track down where I can go to get it sorted. Spoke to 3 gestors this week who i know in the area and none of them knew about this change in residency.

I thought we were in the EU!?? freedom of movement etc!

I understand the pain - from Italy. I too am not married but have lived with somebody for 12 years and are registerd in the town hall as a "living together couple". That gives us a legal registration but not any legal rights. It's a massive contradiction and one which Europe should be doing something about.

But how? If you have lived in the country over 5 years you are entitled to permanent residency. Are they really going to arrest you and put you on a plane out of the country?

Presumably they can escort you out of the country and then you can come straight back and stay for up to ninety days (not sure how they escort you out if there are no borders any more),

Likely it is just to save money, make sure you can't get any benefits

You are only entitled to permanent residency after you have lived here LEGALLY for 5 years. If you never got round to registering the 5 years doesn't count.

If you already have the permanent registration certificate the only way you can be thrown out is if you are a serious threat to national security.

We are talking on this thread about people who are refused the registration certificate because they don't meet the income/health requirements.

But if you have your original certificate which states clearly that you have been here for five years and paid all your taxes but live in an illegal house through no fault of your own then you can be thrown out?

Anyway I have been down again today after being told on the phone that they are now issuing certificates to find out that they arenĀ“t.

Why on earth would the legality of your house be relevant?

If you had the previous residencia card and replaced it with the new certificate, it will show how long you have been in Spain and it should also describe you as a permanent resident.

If you sign onto the register for the first time, not previously having had a residencia card, unless you can prove that you have been legally in Spain for 5 years they will still issue the certificate but it (probably) won't mention permanent residence.

If that was the case you have the option after 5 years to apply for a new permanent certificate.

Unless of course they have changed the rules yet again!

The problem is Fred (or A problem anyway), in this area they only issued non-permanent residence certificates. I've checked with a few people and not one of them has a green sheet stating that it's permanent.

Having been here for nearly 6 years now, I guess we have the option to apply for a permanent version. However, we would now have to go up to Valencia (as they don't have foreigner offices anywhere else near here now) - and that is where the problem starts. They then state that they are NOT issuing them until things are clarified.

So, my choice is to keep quiet and keep what I've got - who's going to know the difference?

Wise decision Snik with so much conflicting advice and experiences being reported everywhere I too would not do it.

Let them get it sorted out and working smoothly first.

I am in the same position and had been quite happy with my old card until I was asked for the green form so I could have a mobile phone contract. Now it is just hassle.

When I went to the Vodafone shop not so long ago they wanted to see my NIE not the green form!
