You are missing the point, had there been a lifeguard as is legally obliged, the boy would not have needed CPR!

And the parents just relax with a glass of wine whilst the lifeguard does the baby sitting job. Sounds a bit wrong to me, but let's blame the owner anyway, eh?

No - you missed the point. If the pool is not open to the public then there is no legal requirement for a lifeguard. I also think this is a very dodgy can of worms to open as many of the community pools could arguably fall into the same category - particularly when there are a lot of 'guests' present. This line of discussion could result in a lot of communities having to fork out for a lifeguard or close! So I suggest it is dropped.

My other point was that this accident has nothing to do with the merits or otherwise of Jags as a restaurant and place of entertainment and has been introduced as a smear - which I would classify as trolling.

BTW I don't believe that there's a "Jag Gang" just a load of people who appreciate the entrepreneurial spirit which has brought a much needed bit of life to what could have been a dying urbanisation. I really don't understand why there is so much vilification

This is no more trolling than the original post here accusing people of trying to close down Jags with no evidence. People being seen having a conversation is no proof of such actions and could also be interpreted as a smear.

Regards the pool, if the pools on Esuri are large enough to legally require a lifeguard, THAT IS THE LAW and lifeguards should be present!
Also, whether or not Jags pool is open to the public or not, which it is not supposed to be, as long as the pool is open he has to supply a lifeguard for the members of the community! He is also responsible for recording the water ph values and having a monthly lab test done, which are also legal requirements, but hey if people fall ill by using the pool, its their own fault for using it if you listen to what the "Jag Gang" say, as of course Jag is not responsible for anything according to some of you.

Are you positioning yourself for 'Jag Gang' party chairman? Mike, come on! Stop with the piffle and platitudes....... and the only vilification has been towards these poor neighbours.

p.s I agree with you that the pool is slightly off topic and you might note that I have not mentioned it until this message. However you raise an interesting point about the community pools. If we should have a lifeguard though, and something did happen, wouldn't the community be hung out to dry legally and therefore financially? Is that really something to kick into the long grass or should it be dealt with?

If you think that was a personal attack you need to join the real world..... It was a a serious question. The 'Jag gang' are bullying people who are only looking to see if they have recourse within the spanish legal system having suffered a loss.

It is obviously impossible to justify this intimidation and I would ask you to please stop.

I think everyone should calm down and look at the reason behind this thread.

It was started to raise awareness about a group of people with or without personal vendettas trying to get a popular establishment closed down. They are said to be behind the music being turned off on a busy evening. They are said to have been turning up at the restaurant to provoke a reaction from the owner. The fact that they are also jumping all over the unfortunate child in the pool episode and blaming it on Jag is confirmation that want to see Jag closed down.

This I why the thread was started, purely to ensure that the supporters of this establishment also have their say before the underhand approach of certain individuals achieves it goal.

Harrybilly - I have already told you that I am none of those. Please don't call me a liar. I only felt compelled to post because I believed the behaivour towards innocent people to be abhorrent. I live in Marina Esuri. I know nobody affected - diversionary tactics.

John and Lynn - The thread hasn't gone off topic - somebody has disagreed with your clique.

Can you all not see what is happening here. The original threads years ago were informative and useful. People had an exchange of views and sometimes very sensble conclusions were reached. As you have gotten to know each other better you are now scared to disagree or debate an issue. I have raised some views that don't agree with your own and I have been singled out, abused and ridiculed.

The stance adopted by the majority ('Jag Gang') is absurd. I know the swimming pool is off topic and I have agreed with that statement in a previous post (and I didnt bring it up) but to use as an example.

- There seems to have been a serious safety related incident in the pool (uncontested)

- Spanish law seems to require a lifeguard to be on duty (uncontested)....

and the consensus is that no lifeguard is needed. How is that joined up thinking!

You have become a clique and where people's views don't tally with your own you seek to discredit them. It has become tantamount to a internet forum based dictator state! Will I be sent to the gulags next!

If you read through my posts all I have said is that those affceted should be entitled to contest the matter without being villified and bullied on a public forum. A basic legal right. Your response to this is to attack me and shout foul play!

Come on, someone in the 'Jag Gang' grow a pair and agree with me ;)

I dont think its a case of growing a pair MT - the point of the whole thread is to try and save a business which we have all used (sorry i dont know if you have or not) - in this day and age i think its important to try and help out any local business - we do when we are over there - we also support all the businesses down in Ayamonte too (as we are on holiday we refuse to cook so we always eat out)
Taking Jags out of the equation - if it was the Golf Club or Manolos i would be objecting to their closure as well as we use them and enjoy their services - CE needs businesses on there for it not to die out - i cannot believe that people would want a business to close down on there - it needs more not them closing down - you as buyers were promised lots of businesses and none of them have developed as yet which i think is really sad - what we should be doing is encouraging them not offering them up to closure - if i could think of a good business that I COULD MAKE MONEY OUT OF ON THERE (coz that is what a business is about is it not) i would open one too - but i work with kids so i dont really think there is any call for my skills unfortunately xxxxx
