Schengen membership for Gib, ‘possible if Spain agrees’

Britain has said it would be “theoretically” possible for Gibraltar to integrate further into the EU acquis, should Gibraltarians desire to do so, including by joining the Schengen Area – but Spain would need to agree.

In their response to the Foreign Affairs Committee published last Friday the UK said that Gibraltar’s existing relationship with the EU does not exactly mirror that of the UK.

“For example, Gibraltar already participates in the Schengen acquis to a different extent than the UK. It would be theoretically possible for Gibraltar to integrate further into the EU acquis, should Gibraltarians desire to do so, including by joining the Schengen Area. In practice, this would require complex and lengthy negotiations, potentially involving changes to the European Treaties on which all EU member states, including Spain, would need to agree,” it said.

The planned consultation will, said the UK Government, help inform the Government of Gibraltar’s position on Gibraltar’s status vis-à-vis the EU.

“The consultation is not limited to Schengen, but will also encompass Gibraltar’s current exclusion from the EU’s Common Customs Treaty. The UK is responsible for Gibraltar’s external relations so ultimately the question is one for the UK Government to address, working closely with the Government of Gibraltar,” it said.

RGP intervenes as Guardia Civil chases local boat

The Royal Gibraltar Police (RGP) had to intervene to prevent the escalation of an incident at sea in which a Guardia Civil vessel reportedly chased a local pleasure boat in British Gibraltar Territorial Waters (BGTW).

It was late on Saturday morning when shipping enthusiast Michael Sanchez spotted the apparently distressed local boat. Mr Sanchez told GBC he called the RGP after seeing the Guardia Civil’s Rio Cedena carry out dangerous “cat and mouse maneuvers” in close proximity to the white cabin cruiser in the waters off the South Mole.

With the incident unfolding just hundreds of metres from the RGP’s Marine Base, their vessel ‘Sir Joshua Hassan’ was able to respond quickly. She made her presence felt before escorting the local boat back into Port.

The Spanish state vessel turned around and headed back to Algeciras, monitored by a Royal Navy RHIB.

If representatives of the Foreign Office - which retains responsibility for defence in Gibraltar - deem that the Guardia Civil vessel tried to exercise jurisdiction in BGTW, a strongly worded formal protest is likely.

Convent To Protest To Spain Following Two Guardia Civil Incidents In BGTW This Weekend

The Office of the Governor has said that it will be sending a protest to the Spanish Government after two incidents this weekend in which the Guardia Civil attempted to exercise jurisdiction over pleasure craft in British Gibraltar Territorial Waters.

The Royal Gibraltar Police and the Royal Navy challenged the Guardia Civil vessels, which later left British waters.

A spokesperson for the Convent said: “The actions of the Guardia Civil in this case constitute a breach of UN Convention on the Law of the Sea and we will be protesting this directly with the Spanish Government.”

It is believed that both incidents were related to allegations by the Guardia Civil of illegal tuna fishing within Spanish Territorial Waters. The Royal Gibraltar Police is investigating further, but is unable to comment on the details of their inquiries at this stage.

An official statement concluded: “The UK strongly supports cooperation between the respective agencies in and around the Strait of Gibraltar, including on law enforcement and maritime safety. However respect for the sovereignty of British Gibraltar Territorial Waters must be upheld at all times. Incursions are a violation of sovereignty, not a threat to it. They do not weaken or undermine the international legal basis for British sovereignty over Gibraltar, including British Gibraltar Territorial Waters.

“We remain in constant communication with the Government of Gibraltar on these issues and No. 6 supports the action taken by the Convent and the UK Government.”

Governor backs greater naval presence in British waters

Governor Sir James Dutton has publicly voiced strong support for the deployment of a larger British naval vessel to patrol Gibraltar’s territorial waters.

Sir James, a retired Royal Marine with a distinguished military record, said such a move would send “a really valuable message” in the face of persistent incursions by Spanish state vessels.

Having just read the article on Algarve Daily News about the " apalling treatment " of Gib football supporters in the Algarve that we have not heard from the " Gib " propoganda department claiming that Portugal is colluding with Spain and victimising Gibraltarians.!!

I am at present sat in a hotel overlooking the frontier between an EU country and a non EU country
One has a VAT rate of 22% the other 8%
One uses euros the other has it's own currency.
Their are no immigration controls and no customs controls.
People and cars are crossing this frontier as though it doesn't exist

Must drop a note to Rajoy

BATTLE OF BRITAIN’ JETS COMPLY WITH SPANISH BAN

Two Royal Air Force jets will comply with the Spanish government's ‘deeply regrettable’ restrictions on military movements when they leave Gibraltar this weekend bound for a NATO exercise in Spain. The two Hawk jets are in Gibraltar to carry out a flypast this evening in honour of pilots who died in the Battle of Britain.

US politicians present formal Gibraltar 'Self Determination' motion

Seven senior and influential US politicians, led by North Carolina Republican Congressman Goerge Holding, have presented a motion to the House of Representatives calling for support for Gibraltar's right to Self Determination. The motion recalls Gibraltar's importance as a military base during WWII, and continuing use during NATO operations in the Middle East.


The motion notes that Gibraltarians have chosen, through two Referenda in 1967 and 2002, to remain part of Britain, and recalls how important Gibraltar has been as a strategic military base to the interests of US overseas interests, ever since 1801.
The motion honours the Contribution that Gibraltar has made to advancing America's military interests, and expresses the view that the rights of Gibraltarians should always be imperative in any discussion over the Rock's future.
