Agree with Kay O Ness.Kind of glad we didn't go ahead with a purchase many moons ago when M Fadesa first opened its doors.Such a lot of bickering..I know there are many problems,have watched over a number of years.But you live in a lovely area,and unlike many of us who have still to sit out the recession,you have something to enjoy.

I agree - gone on too long.. which is why I said I was pausing for a while on this thread.

BTW there is more than 1 Alice on CE, and I always thought we knew each other, but got it wrong.. I'm not sure Alice-on-this-thread and I know each other. Confirmed when the Alice-I-do-know went out a couple of times for drinks.

CE updates continue on the relevant threads re Jags/golf/resto etc. Go there and leave this mess....!

For us Costa Esuri is a very special place, where we have enjoyed many holidays and breaks from the UK.

Part of its attraction is watching its gradual evolvement and envisaging how it will eventually materialise in many years to come.
Another attraction is the people! Friendly, helpful, supportive and polite are characteristics that immediately come to mind.

For these reasons, amongst others, I encourage considered, informed, inoffensive and questioning discussion on the issues relating to the legality of the EUC.

Some have already taken the opportunity to air their views at length; in one case now opting to "leave this mess"!

Perhaps there may now be the opportunity for others who have pertinent issues to raise and valid opinions to express, which will enable others to come to their own conclusions re the Action.

Hi everybody,

It has been some time since my last post here.

I just wanted to answer some concerns I have received through the email regarding what would happen in the different scenarios after the class action is finished. It seems I have not been clear enough in some comments. Well, here it is a sum up:

1st scenario - We completely win
Then, the EUC is dissolved, the Ayamonte Town Hall takes care of all the public services (as it does in Isla Canela or any other urbanization all over Spain), the obligation to pay the EUC fee ceases for everybody and the people joining the action receive the money paid back to them plus interests.

2nd scenario - We partially win
Then, it could be differnet scenarios, but let's say, the most probable, the EUC would not be dissolved and would continue its activities, but people joining the action would have the right to leave the EUC (and stop payments of the EUC fee) and would receive the money paid from the date of the initial complaint plus interests.

3rd scenario - We lose
In this case, things would continue as of today, nothing more, nothing less.

4th scenario We lose and we are required to pay the legal fees of the other party in the lawsuit.
Although this is a highly unlikely scenario, I do not want nobody thinks I want to hide it. Then, it would be like scenario 3 plus the legal costs of the defendant would be spread among the plaintiffs joining the action.

Please, let me know if there is till doubts regarding this or other issues.

I hope you all are enjoying the summer, either on vacation or working, and hope to see you very soon. I will be in Ayamonte the first days on September, just in case, any of you wants to meet, I already know I have some people here in my agenda, so stay in touch.

Hi all, for those who may still be interested in joining the class action and not managed to get around to it yet, the deadline has been extended to the end of October.
Pablo recently sent an email to his mailing list as shown below. The uptake has been successful so far and with more interest being shown, Pablo is extending the deadline for those who are interested.
Given that official offices are generally closed during August, this is a good idea to extend the time and will allow those interested more time to finalise their documentation.
Once again, thank you Pablo for taking the initiative on this matter.

Hi John,

The total cost would be around 190€ (155€ + 35€ as notarial fees).

OK that's not outrageous however what is the extent of the Power that we grant at the Notary? Is it specific to this action and only this action or is it a general power that means the abogado can dip into my bank account should things go badly?

It is a power of attorney specific to defend your rights in the Court in this specific lawsuit or any subsequent lawsuit you may have should you decide to hire any of those lawyers appearing in the power. I cannot dip into your account no matter what. No lawyer can do that with a power of attorney for litigation.

Attached, you can find an accurate translation of the power of attorney you will be signing in case you decide to join.

Ref 4th scenario, would you please give us your best estimate of potential legal fees for the other party, plus the number of people who have joined the action to date - that would enable us to estimate cost per owner/apartment should we lose the action. I think that this information might help people in deciding whether to join the class action.

Also, please confirm the process for joining the class action.

Hello Fred,

An estimation of the other party legal fees:
- 1a instancia (there is not appeal): 3000-4000€
- If there is appeal: Around 6000-6500€

As of today, there are 40 properties who already joined. Thus, it would be no more than 100€ each propery, and if there is appeal around 150€ per property. This is just an estimation, and it is hard to say a specific number.


The process to join:
- Sign a power of attorney in the notary and obtain a "nota simple" or equivalent document to show the ownership of a real property in Costa Esuri.
- Sign the retainer agreement and pay the legal fees (155€).

Hi everybody,

I just wanted to follow-up with the update of this process. Yesterday, we have brought the prior administrative claim against the Ayamonte Town Hall regarding the EUC and the maintenance fee.

Now it is the Town Hall who has 6 months to answer and if they do not answer or they refuse our claim, then we can initiate the judicial action.

Finally, it has been 53 owners who joined the action. Around 20 of them are either English or Irish.

The news has been published in some local newspapers, and apparently will appear today in the TV channel "Canal Sur" during the afternoon.
