This is exactly where passing the responsibility to the individual would be impossible. One person's crazy idea of what is acceptable would be unacceptable to others.
Speaking to passengers in the same car is hardly the same as reaching over to the mobile (when not using hands free), taking eyes off the road to press the answer button and then holding phone to one ear which only leaves one hand on the wheel.

If you are talking to someone hands free it is totally the same as talking to someone in the car, and I mentioned if you were ban people using phones then you should ban hands free also, but then how do you ban people talking to passengers
If you are listening to the radio you can become engrossed in the discussion and immediately you are distracted. Also if you are on hands free people will still be dialling whilst driving.I saw a programme on TV which talked about the fact that all your concentration should be totally on controlling the car, but in fact you are multi tasking so much whilst your driving that your concentration on driving is reduced considerably.

The most crazy blood boiling piece of driving I have seen in years of witnessing crazy Spanish drivers was on the toll road, thankfully it is not a heavily used road and there was hardly any traffic about. I approached a Merc that was doing about 50kmh but I could see that it was going from inside lane, to the middle of the road over the line between lanes, then back to inside lane, and so on. I was stuck behind this car for ages for fear of overtaking and getting shunted off the road as there was clearly something wrong. The driver had not taken any notice of my flashing lights or sounding of my horn, he was oblivious to me, until the car jerked quickly into the inside lane and stayed there. I got the bottle to overtake and as I slowly did so, I could see this big fat moustachioed prick trying to text on his phone.
Someone's life could be snuffed out by that selfish **** just because he's telling his missus to get the dinner on so he can make his gut even bigger.
