Hi Dave
Sorry if I wasnt clear, in our case the lawyer estimated all the charges, and we paid in advance - and of course he over estimated.. so he had the money. As much as I deeply regret using my lawyer, I do understand that in this particular subject, he did nothing wrong, making sure that there was enough money up front to complete... better safe than sorry. I got the money as I chased it and was there in Ayamonte to ensure that I got it. Note, I dont want to set false expectations: as there may be no refund, and the lawyer might have correctly calculated it. Also you may have already gotten it somehow. But I think some people didnt realise that these charges were estimated and havent thought about querying the final account with the lawyer. I'm not the only one that has had a good refund. The refund was well worth it, for us - a significant amount. It may not be the same, if any, for others. So this post only applies to someone if 1) they paid UP FRONT for their completion and if 2) they havent had a final account after completion. BTW this is a shame to have to chase it up and not just receive it, but hey if you get something as a result of this, it could be a nice surprise. Mr Positive talking here :) Hope this helps anyone in the above situation, and of course the lawyer is obligated to return any outstanding money, if you fit into this situation - if so theres no harm in asking surely? Regards + good luck Jon

Just to elaborate a bit further on this point....regardless of whether you use a solicitor/estate agent or deal direct with the bank you will always have to make a "provisión de fondos" before completion which should be an overestimate of your purchase costs. Basically the bank/Notary needs to ensure that you have enough ready cash to pay every Tom, Dick and Harry who takes a cut when you purchase a house.
Once the true cost has been calculated after completion (could take 2 or 3 months) you are due the reimbursement. You shouldn't have to chase it up....that's pretty poor service if you do. Seeing as you have a current account with your mortgage lender the bank should pay it directly into your account. I got back just over 1000 euros, so you should be keeping an eagle eye on your bank account to make sure it comes in, and don't forget about it!!

Thanks John, very interesting. It may be why I've havent received a final statement for either of my purchase, house or plot. I've only been chasing it for two years ........... Due to have a face to face in Aug, will be interesting.
Regards Dave I don't want to set any false expectations to anybody else reading this, that's why my last post was full of caveats, see above. I don't have any expertise here and certainly don't know if this works for everybody. But already we've had a post from Veleta saying the refund was over a thousand, in her case she had a good lawyer that settled up, and all she had to do was keep an 'eagle eye' on the bank account. Also the people I know that chased it (myself included) have had refunds in several hundreds of euro's if not over a thousand - that's for an appartment. If it's standard practice to overestimate the charges (and I don't disagree with it) then the lawyer should of course settle up after completion, but if he hasn't and sadly, if one has to chase them all over the place, it may still be worth all the hassle - in the end. I personally couldn't let it slip, and would always expect to see a proper accounting for any business transaction. Nor is it in my character to let someone get away with delaying - or worse - not settling up an overcharge. So I for one think its worth going for, if anyone is in the specific case in my earlier post (above). Anyway I think Ive posted enough about this, this post has all the relevant posts included in one place - so Ill duck out of this in the hope that some people have been helped Hope to meet up sometime too, Dave. Cheers Jon |

Only joking, they were very well behaved. Lynn told me to put that post up to wind you up!
Once they get on that stuff they can be a bit of a handful, especially the "mate". Consider yourself lucky and glad they behaved themselves. I'd hate for you to bar me based on their druken actions. |

Nice one Jag. You notice I didn't question the first post, as I know what they can be like!!

On another note, noticed a lot of activity on the empty apartments in Rago 1 yesterday, in our block and the one across the way, they were all being cleaned. Wonder what this means!! And some of the renters appeared to have moved out or in process of doing so. Lynn |

Re: COSTA ESURI - AYAMONTE
Hi all
Re. Jon-BXL post about refunds, we had a refund but I didn't want to post until I checked the details and understand Jon's concern about raising false hopes, however awful to miss out if you are rightly due a return so it is worth checking. Good on you Jon for posting about it ! I did have to push our solicitors, I am sure our account would have been credited but at a much later date if I had not pressurised. Our circumstances were that we cancelled the existing Fadesa mortage on the property and took one out with another provider. We had to pay to do this in the first place and I have to say the circumstances surrounding this were not made clear. Our refund was:- Notary 425 Land Registry 216 Management Fees 244 End of Work 360 Total €1245 credited to our account 5 months after completion. Hope this helps anybody else in the same situation.
