Happy Christmas to everyone - hope all of you sorted and settled have a great Christmas.
Still in limbo and not wishing to put any form of damper on things I need to ask my friends on the expats site for help once again especially from all you Spanish nationals or better speakers of Spanish.
This morning I received the attached by registered mail and was told I had to sign a paper that was to go back to Spain to the Fadesa administrators. I rang my solicitor but received a recorded message to say the office is closed until the 12th January for the holidays - and I thought we took long holidays. My Spanish is rubbish and I don't understand much of this but it seems to be talking about something that might need doing or checking 10 days from receipt of this letter. I think it might be recognising that we are a creditor but I am not sure. If there is anyone out there can give us the gist of what this says until we manage to speak to our solicitor I would be most grateful. I have scanned it and sorry but it does not scan too well - hopefully there is enought to make some sense.

I sent the letter to my solicitor on Christmas Eve and they were still working, thankfully. I've asked them to let me know what the implications are to me. I'll let you know what their response is.

En consecuencia, el comprador de un bien inmueble (vivienda, garaje, local, oficina, trastero, parcela, suelo o cualquier otro bien) que suscribio un contrato privado de compra con MARTINSA-FADESA, S.A. no se considera -en principio- acreedor de la concursada, pues no se le debe cantidad economica alguna, aunque existe evidentemente una obligacion de escriturar y entregar el bien en la fecha pactada en el contrato privado, pero ello no convierte sin mas al comprador en acreedor durante el concurso, salvo en los supuestos de incumplimiento. Reading the rest of the letter I understand that this information was made public on the 10th December - our solicitor did not contact us. So I don't know if the necessary paperwork has been completed on our behalf.
Our solicitor is on holiday until the 12th and well after the date - cannot find which forms need completing so have given up apart from writing an email to our solicitor. Not hopeful however.
Seems we will have lost the deposits after all. As we appear to have no bank guarantee, don't have a completion date on our contract and were unhappy with the finished product anyway as it did not match original plans. Hope others are in a better position. MY OH has had enough - I think we won't be buying in Spain after all.
