Deadline for filing as a creditor of Martnsa Fadesa´s judicial administrators finishes on the 30th September according to information provided by the Court dealing with the Creditor´s meeting procedure in La Coruña. Regards, John. |

Just got back from two weeks in CE, great to meet some of those on the forum or those who read it. Heres some news following on from other things brought up on this thread Fas De Gostos the fne dining place in Castro Marim really is nice, great food but alas its closing this week and moving to Faro , the next best place for fine dining seems to be Praia Verde!!!! Jags really does do lovely curries, fresh and spiced none of that horrid aftertaste you get at the usual curry houses. Sally who provides massage, reflexology etc - had a massage , it was lovely, so relaxing she comes round to your house and you just chill, a very pleasant experience. But one thing I am still not sure of -Snagging or rather the lack of it, to fix those problems in your new home, Vanesa in after sales mentioned that if you need work done you should hire someone and send the bill to Fadessa, that sounds sensible but does that then mean you become a creditor and if so in theory you need to have this work done before 30th September in order to get the bill into them and meeting the creditor filing deadline, I spoke to a few folks whilst in CE and no one really knew for sure, any ideas? or am I way off? |

Can anyone tell me what the hell is going on? As one of the group that have not completed we have just received an email from our solicitors telling us we (or in other words them) have to appear at some aforementioned proceedings to protect our rights - and it must be done through a legal representative for which the solicitor will charge us 1750 euros. It does not actually say we are creditors. The email asks for all the things they already have i.e. contract - we have never had the original etc receipts - Fadesa only ever sent some. Nothing else suggested - no attempt to get a reduced price. In the summer we were told we were not a creditor and it would be fine. Now I hear from friends that there will be no exchanges - this was why we did not complete - we wanted to exchange our selected property or another. So it seems the choice is that you might possibly be able to get what you were offered - and you pay full whack on a falling market and you pay the solicitor to do the job they should have sorted out a year ago.
What happens if I do nothing? Do I lose the 30%? Would I not be better letting that go and waiting to see if I get what I want with the 70% I have not paid out yet? We are being asked to send contract, payments and power of attorney for litigation by the 22nd of Sept as a 30 day window to register as a creditor. I have read the blog over the last 3 to 6 months and i do not know whether we are a creditor on not can someone advise please? We are buying a plot in R14 or 22 can't remeber which and have put down a deposit of about £40K does that secure our land for us to carry on purchasing or is MF legally allowed to claim it back to pay of creditors? The paperwork says 1750 euros for 1st "property 2750 euros for 2 properties and 3000 euros for 3+ properties, I have no property do I still need to register as a creditor or not? some advice would be very welcome the sooner the better please Ken |
