Yes, the 130 has been approved and the 129 is pending. But he is here in the country and wants to know if there's anyway to stay and file something else since the timeline looks like December for it...

Yes, you have to mail it unless you are traveling withing 14 days. If you are and live within a passport service center area, you can set up an appointment. I still have 8 or so years on mine, hope...

I spoke with an operator last week and was told (as the US citizen) I wouldn't need a new passport - they would just do the name change amendment on the last page.

Yeah that's what I am afraid of - them not forwarding it. But it's truly a great day if we get our own mail anway. Not really sure if reading and numbers were a prerequisite for our postman.

The NOA, if it's the same one we received, should say Form I-797 or I-797 (c) at the bottom. It can be used as a secondary document.

We have not received our AP yet, so I am not sure what form...

Not totally true. David got his SSN with no stipulations. I'm not sure if that's because we came through JFK and got the 90 day stamp or what. He worked from the second week he got here.

We walked ours in just for the slight chance that someone hadn't gotten the memo, and decided to issue one on the spot. No luck! Seems that's the only memo, everyone DID get! =)

I don't see either scenario working. With #1, you are leaving the US and "abandoning" you K-1 Status, as the cruise goes to Vancouver.

In #2, you are trying to enter and leave the US, which sounds...

Yes but the DMV, here in Virginia, will take it as proof of legal presence. And since they passed the law effective January 1st, that you now have to prove that as well as being a resident, as well...

It's for the I-129F... Long story short, It's passed the expiration date, but we wanted to use it to get his Driver's License, as Arlington does not issue an NOA, I-797 for AOS/EAD. So we need one...
