Will i get in ? Frodo, how u get ur visa?
How the hell did frodo Baggins get his B2 visa if he said he had a girlfriend in the USA & more so if he's English.
I was denied i have been told for these 2 reasons. ?
I'm going to ask again because i hope to try & go soon on the waiver, but i shouldn't have applied, i only did it because i thought i would get more time! I didn't expect it to affect me using the waiver.
Surely immigration have more on their plate at the moment than a British tourist.
I f i just tell the truth like Frodo Baggins when i get to immigration that i am going to visit my gf will this work, i told the embassy this & this is why i thought i was denied. Will immigration know about my gf when i get to the states? or should i just say i'm travelling. Both are true. It was the end of October when i returned. I now have an appointment to return for surgery along with my letter from an employer, bank statements & letter from family i'm staying with & letter from my parents saying i'll be returning there. I don't have kids or a property.

Re: Frodo, how did you get yours..!
It wasn't easy. I took everything I had with me to prove I had ties but the
only thing that allowed the agent to give me the benefit of the doubt was
that I have a 9 year old daughter in England. Her name just happens to be in
my passport and that gave her conclusive proof that I have ties in England.
As for telling the truth, I have told the truth at the Embassy and at the
POE. On one trip however on the VWP, I did get taken aside for further
questioning (including a bag and wallet search) but once they know my story,
it's all cleared up.
One agent even asked me if marriage was involved and I said it was. He just
laughed and told me to get started on the paperwork as there was lots to it.
I looked out for him on every trip (funny, the trip where I got pulled aside
was when that friendly agent wasn't at the desk).
But the main hurdle you have in applying for a B2 in England is that they'll
ask you why you are applying when you can simply use the VWP. My answer to
that question was that I had used the VWP five times and the last trip I was
pulled aside and they recommended I get a Visa for my next trip else entry
could be a problem. Rather than fly only to be denied entry, I decided to
get a B2.

Normally this is hard as you say so having been denied already should i try again, although i'll probably be denied again as nothing has realy changed exept the hospital appointment, or just go on the waiver?? If i just say the truth that i made a big mistake not knowing it would affect me, would i be fine, it's the truth & they are human!

Re: Frodo, how did you get yours..!
I can't give you a yes or no to your question.
REMEMBER, I AM NOT A LAWYER AND ONLY SPEAK FROM MY IMMIGRATION EXPERIENCE!!
As far as I am aware, if you apply for a Visa and are denied, you may not
use the VWP, well legally anyway.
So, you should apply for a B2 again. If you have a letter stating a date and
time for surgery, that would help a lot. You could even take the risk of
purchasing a ticket to show you have a return date before your surgery BUT
THAT IS A BIG RISK. You may be denied and you've wasted a ticket.
But at this stage, what have you got to lose?
If you want to e-mail me privately, my e-mail address is
[email protected] and I'll be happy to discuss my situation with you. My
girlfriend (now my wife) had a hard time trying to cope with the fear of not
being able to see each other again but we pulled through.

As far as I am aware, if you apply for a Visa and are denied, you may not
use the VWP, well legally anyway.
This is NOT true.

According to the USA Consulate in London, people refused visas under
221(g) or 214(b) are allowed to use the VWP.

After my denial i was issued a form which stated that i could not appeal the decision, but i could request an explanation. I wrote to the embassy concerning this & also stated that it was a mistake to have applied & would they consider the Bond system, which does exist & that they could do on my behalf.
I just am pissed off that this error on my behalf is ruining my planned trip to travel, although i have myself to blame, surely the people at the embassy would be understanding.
I requested the help of my MP who has written to them, but neither of us have had a reply after at least a month, i feel i should contact them again.
