Hi I shall be grateful if anyone can guide us.
Im writing from India and filed for Skilled 136 BN Immigration to Australia in August 2007 after positive TRA assessment in July. My Wife is the principal applicant, a Hair Dresser with 8 yrs experience.
We are really concerned regarding our application as we have recently noticed lots of rejections for Hair Dressers applications in India without even a CO begin assigned or as much as a verification. (India being High Risk Country and lots of bogus applications filed)
We think that DIAC has already started implementing the new MAP policy which was supposed to replace UAC in September next month.
I'm writing to seek your guidance for this application and future course of action as we dont want our File to be on Autopilot. Shall be grateful if you could please enlighten us:
• With the new implementation of MAP will our application be accessed under the pre August 2007 rules or shall our application be affected by MAP? I think they are doing this only for High Risk Countries as Ive noticed in this forum that Aug 07 HairDresser applications have already been assigned Visas.
• Are our fears of rejection Valid?
• What else can we do now in order to obtain a favourable assessment? I have heard that we could invite them for a personal assessment wherein they access your hair dressing skills at your salon to the level of AVQ 3?
• Can we invite them even now as our file is under process?
I know lots of questions but would anyway appreciate solutions.
A Very Concerned Couple
Thank you in advance.

Case officer will be assigned for your case and they will verify your wife's experience as ' Hair Dresser'
If your case is rejected, they will inform you in writing why such decision was taken. And still you have the right to appeal again.
Don't be panicky.
With respect to volunteer invitation for skills assessment, I am not sure about the procedure, check with your consultant/agent if you have one.

Since you had applied in Aug2007 after TRA's approval, I don't think your application will be rejected just like that.
Case officer will be assigned for your case and they will verify your wife's experience as ' Hair Dresser'
If your case is rejected, they will inform you in writing why such decision was taken. And still you have the right to appeal again.

That's a bit unnecessary
If you can't or aren't willing to help, I'd suggest you keep your thoughts to yourself. There's plenty of people on here who aren't "British Expats" both giving and receiving advice.
Dorothy, one of the most helpful and useful people here, is Canadian I believe as is Comet555. Do you have a problem with that?

As for the appeal, your agent is right. There is no right of appeal on a skilled 136 visa application.

Should I take this to mean that you think all "foreigners" should get off the site? Or are you just refering to people from India? Either way I think your comment is a bit insulting!
In case you haven't noticed yet there are people from all of the world that use this site. I started out here because it was the best place to get information & help for immigrating to Australia. I keep coming because I like the people and discussions and also to try and help other people just starting out in the process.
For the most part I have found this site very welcoming.... aside from your comments of course.

In answer to your question, if your wife is actually working as a hairdresser in a decent salon and you have been entirely truthful in your application then you should have nothing to worry about. The applications are being refused when applicants "stretch" the truth. I know of one applicant who was rejected because when DIAC came to visit the "salon" she worked at they found that there weren't even sinks.
As for the appeal, your agent is right. There is no right of appeal on a skilled 136 visa application.

BTW I've just found from an agent and he has also predicted that our application is Doomed and the only way we can save the application now is if we invite DIAC for an independent Skills assesement? Which is going to cost me 4000 Aussie Dollars. Where do I write to appeal for this? TRA, VETASSESS ?

Yes she works in a decent salon. Alright. Infact she owns the salon. But we are seeing a pattern emerging with regards to HairDresser Applications. Hair Dresser Applications has been withheld for quite long with no CO assigned etc. Many have been been rejected outright.

However i do agree that a lot of Hairdressers have been rejected from India of late, particularly from Punjab & Gujrat, and thats creating negetive thoughts in ur mind. But then i m sure 80 % of those applicants were fraud and their TRA applications were prepared by agents who had quite a bit of experience and knew how to get it right with TRA. And when it came down to employment verification most of the saloons did not have sinks, geysers, particular hair-cutting scissors etc etc... However if ur Sallon is well equiped with all the basic equipments & infrastucture & meets their normal standard, and provided that ur wife is able to physically prove her employment claim during her verification, then it shouldn't be a problem.
And before i end mate, i want u to know that DIAC is there to grant u a visa and not to reject u, provided that all the info u provided was true, honest & transparent.
Cheers.
