Help if possible, new visa rules.

As most of you know, i was lucky to get a new 5 year x visa, then everything went wrong, Dad died, mum very sick, so im stuck in Spain nursing my old Mum, so my 5 year x hasnt been used as yet.
Next season, i hope to get back to Goa, but for short periods, hopping back and forth to Spain, keeping an eye on Mum.
Somewhere on British Expats ive read a list of the new stupid visa rules, I.E. the new 2 month rule.
Is it possible one of you kind people, would print this again, i want to print it off, because it states, rules for tourist visas, and not x visas.
I just want a copy, in case the airline get funny, i can show this.
Many thanks.
P.S. Ive heard from my friends in Goa that prices have jumped again this season???::thumbsup:

Re: Help if possible, new visa rules.

If you read the above link it states that a Tourist Visa can only be given to foreigners who do not have a residence in India.

And the FEMA regulations about foreigners "owning" property in India if they fulfil the 182 days plus residency in India in a financial year "for any other reason" being deemed "residents of India" (my "other reason" is that I want a hassle-free retirement in the sun)

SO, my very "confused" question is...............for those of us who have legitimately "purchased" a flat/villa for our retirement, whether we have it with registered sale deeds, on 5 year "leases" (renewable, as with Acron in Goa) or just on Sale Agreement, and are able to spend more than 182 days per year in India just because we ARE retired............just what sort of VISA is there for people like us?
As far as I can see - NOTHING - just a simple 6 month Tourist visa staying no more than 180 days, then a 2 month gap "somewhere out of India" and re-applying back in the UK for a further 6 month T visa, and so on..............

Certainly not the kind of retirement I had envisaged.................... & :(

The British High Commission have actually asked that question for us; I am waiting, but not holding my breathe, to hear the reply from Govt of India.

The problem of course is that there isn't an answer - not without changing some rules with the associated massive loss of face for some v. senior babus!

Thanks Andy

I'm not holding my breath, but you never know when lots of countries unite and ask the same question(s).

It can't be all TAKE, TAKE, TAKE - they have to give a bit too.........

Ever hopeful.

You are also subject to State laws. You must be able to stay for an "indefinite" period. If you have a visa, then it is "definite" because there is a most obvious time limit.

Yes we had a 5 year x - then 2 year x - 1 year x (which they did not extend)
now a useless 6 month multi entry. indefinte period now is 6 months if you stay put - will it be 90 days next year :banghead::banghead:

WRONG
You must be able to stay for an "uncertain" period.

I've given a detailed explanation of the difference so many times I can't be arsed to do it again - if you're interested do a search on my previous posts, or look it up in a good dictionary.

The fact that there is an upper limit to the length of a period of time does not mean that the length is known without doubt.

Thanks AndyD - I DO recall having seen your comments somewhere before and when I get a bit of time I'll trawl thro' the threads & find it/them.

Trouble is, who will be there to listen with a sympathetic ear as to why one would want to stay for an uncertain time?

All they like to hear is the rustle of the rupee notes................:rofl::rofl:

All of these "rules and regulations" are fine if there is a continuity of application. Unfortunately this does not exist! I am so sad that many people cannnot see that the end is nigh. As I said before, we are so sorry and sympathetic to ALL of you (although that is probably not what you need) but pehaps a reality check is needed. The world is a big place and I know that many of you have sunk a lot of money into the place but what are you going to do? It is like Russian Roulette. Are you going to wait for the bullet? Better to not pick the gun up.

I would have thought that a fact is without doubt

there are no guns, no bullets, no fatal games - and for many people no getting out.
There is hassle, you live with it, work around it or just ignore it.
