My cousin is doing both(sponsor and assurer) He lives in Redcliffe,area code 4020.

I'm surprised an area so close to Brisbane should be 'designated' but postcode 4020 certainly looks ok by DIMIA:

You'll need to show proof of his residence there for at least 12 months prior to your application.

That is *not* a good idea.

For skilled sponsored, you must provide a sponsorship form (form 40) and an Assurance of Support form (form 28) with the application. If you do not, there is a high risk of refusal.

The Migration Regulations insist that (for general skilled sponsored applications) sponsorship and assurance documentation be provided at time of application.

There is talk that the requirement for an Assurance of Support at time of application will be discontinued from 1 July. I've not yet seen the relevant legislation.

Thanks for that Jeremy.My agent in London is hinting at submitting the forms without my sponsors forms,but I was uncomfortable with that.Its like how can you apply for a sponsored visa without a sponsor.Doesnt make sense does it.

Uncles Cert Birth Certificate Arrived from Ireland in the post this morning.

We were fortunate enough to be able to submit the sponsors & assurers form with our application. However after we received the letter requesting meds & PCCs our agents admin office said we will also NOW be required to submit our sponsors & assurers forms before the assurers bond could be lodge as they need to check his financial situation....

Well we cleared that up for us but the point is that said with the rest of the conversation indicated & showed to us that you can lodge the application WITHOUT those forms...and we have been told that you can do that and send in the rest of the documentation as you get it.

All I'm saying is that in my understanding an application for skilled sponsored lodged without sponsorship and assurance forms is destined straight for the refusal bin.

The Migration Regulations say as follows:

139.212 The applicant is sponsored by the sponsor.
...
139.214 An assurance of support in relation to the applicant has been given, and has been accepted by the Minister.

Note the phrase *time of application*.
Rules are similar for subclass 138 (Skilled Australian Sponsored).

It's unclear what exactly is meant by this.
However, DIMIA will not mind how long you take to apply - TRA assessments are valid indefinitely.

The warning of course is that as long as you haven't applied, you remain vulnerable to any rule or policy changes. And the later you apply for the visa (normally) the later you get it.

But has anyone ever wondered why it therefore takes nearly 6-12 months before you hear of that decision?

Could 'At the time' not be the moment it is received but possibly any moment in time between then and up to 12months or more later when they eventually get around to looking at the application and maknig that decision or whether or not to put it in the bin??....so maybe in that frozen moment you could slip in the paperwork that was missing when you sent it off!

LOL....just a thought, nothing serious, just my cynical view of the system.

I agree for anyone in this situation it's oft best to get proper advice from an Agent before you act.
