Excellent news. The bill still has to pass in the Senate though which is notoriously slow, and they only have until Dec 20th to do so. They would need to agree to the bill as written without amendment to make that happen which might be a tough call. But definitely hope. Either way we should know the end result soon.

Great news!!

I just applied for my SS to start in February next year when I'll be 70 so I am now filled with hope of a possible extra $400/mo if I don't get WEP'ed.

Well this is a surprise! I was going to work another 6 months or so because next year i reach 30 years of SS. But i might just hand in my notice today 😁

I don't think it has ever made it this far. The House has passed HR 82. Now the Senate needs to pass S. 597 and President Biden must sign it. All by the 20th of December.
I think with 10 years SS I was at max WEP which is a deduction of $587 pcm, which would be a welcome change.

Yes, here's me dancing around taking SS at 62 and not taking any UK defined contributions till the UK state pension age of 67, just so I could get 5 years of non-WEP'd SS and I might not have to bother with that at all. Defo won't count my chickens.

Said it was a duplicate..
I thought it was a good idea to have a separate thread, so this news was not buried deep in this thread, that was more of a WEP question...

I know this is all a bit premature but has anyone figured out how the adjustment will be made for those already being “ wep’d” . The bill says the adjustment will be made retroactively to social security checks received after December 2023.

I’ll use my situation as an example. I started drawing social security in 2018. Because part of my U.K. State pension was not voluntary contributions, my SS check took a one time $125 reduction (50% of the wepable part of my U.K. State pension).

So if the Senate and President Biden sign this Bill into law, will I receive a retroactive check for 12x $125, or 15 x $125 if the payments don’t begin until March 2025 for example? Also will there be a cola adjustment of 8.7% added to my $125 before the above retroactive payment is made, e.g, $135.93 x 12 or 15?

Yes, I have way too much time on my hands.

Thanks for your post in response to Goldenkey2024. You seem very knowledgeable on this subject of impacts of WEP on US SS payments to retirees. To clarify what I read from you, if I retire with 31 years of regular full year payments to Social Security - I should not be impacted by the (current) WEP policies?

FYI
The House passed the Social Security Fairness Act on Nov 26th. This legislation would eliminate the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO).
The next step is for the Senate to pass their version of the bill, S.597.

Getting it passed may be a longshot, but making a noise helps. If you are inclined to do so, let them know you want them to get S.597 to the floor and voted on ASAP:
