Hi,

To enable me to take my children to live with me in the US, I need a letter or document giving permission from their father. Whilst waiting for our approved petition to reach London, I emailed the embassy asking what they require me to take to fulfil this. Their website says this:

"If you are divorced and you are applying for a visa for your child(ren) by a previous marriage, you will be required to present on the day of your visa interview proof that you have been awarded custody of the child(ren) by the court and that permission has been given for the child(ren) to be taken out of the United Kingdom." The embassy emailed me back today with this response:

"Letter from father giving permission to remove the children from the UK to reside in the US which must be notarized."

I am wondering if anyone can help me with the wording of the letter? Also, would it be ok to get it notarized at my local solicitor's (lawyer's) office?

I think what you wrote is fine but I also think that it has to be notorised by a US notary and as far as I know, the only way to have that done in the UK is at the US Embassy in London. I think they charge (something like $30) and I'm pretty sure that the letter may need to be signed by your ex husband in front of the Notary too.

If I were you, I would just have your ex sign the letter in front of your solicitor and take that plus 1 copy to the embassy on the day of your interview and see what they say (maybe offer our ex's elephone number so they can call to confirm should they need to) - it may be just fine, but if not, the worst that can happen is they will send you away without the visa and ask you to provide whatever additional documents they need to proceed to visa issuance.

My son's dad and I were never married and an agreement was never set
in place when he was born and after we split up. We were lucky in
that everything was mutually agreed upon and it all worked out well;
never any problems. So....I went to a lawyer's office to have a
document drawn up by him, signed by him, signed by me, signed by my
son's dad's lawyer and also signed by his lawyer. Here is what it
said and was accepted by the U.S. Consulate in Montreal:


This custody agreement made as of the _____ day of ________, 2002.

BETWEEN:


(My Name)

and

(Father's Name)

both of whom are sometimes herein referred to as the parties and each
of whom is a party.

1. Recitals and Consideration

Whereas the parties are a man and a woman who were never married to
each other.

and Whereas the parties wish to provide for the settlement of their
respective rights and obligations concerning custody and access to the
child.

Now therefore in consideration of the premises, these presents and the
mutual convenants herein contained, the parties agree and convenant as
follows:

2. Custody and Access

(1) (My name) will have sole custody of the child, (Son's Name) and
(Father's Name) will have reasonable access to the child upon
reasonable notice.

3. Emigration

(Father's Name) acknowledges that he is aware that (My Name) and
(Son's Name) plan to emigrate to (State Name) in the United States in
or about (Month), 2002 and that (My Name) plans to marry (Fiance's
Name) and remain in the U.S. By his signature on this agreement,
(Father's Name) hereby gives his consent to the emigration of (My
Name) and (Son's Name) to the United States.

4. Voluntary Agreement

(My Name) and (Father's Name) acknowledge that they are entering into
this agreement without any undue influence, fraud or coercion and are
signing this agreement voluntarily.

And witness that in accordance with the terms herein, (My Name) has
executed this Agreement setting hereto her hand and seal at (City

Hi Debbie
I got my lawyer here in the UK to draw up a document
called a Statuatory Declaration.
It lists the following:
Marriage details and children of that marriage.
Divorce details and date of Decree Absolute.
Court Orders (if any) pertaining to the children.
The fact that I will be living permaanently in the USA with my daughter.
My ex-wifes agreement on this.
Trips back to the UK to be paid for by me.
Telephone and emai access for my ex-wife.
This is then signed by both parents in front of a lawyer.
Total cost was £100 plus VAT.
