will i be out of status?
Hi, i have a question; any answer will be appreciated.
I am currently an F2 visa holder because i am married to an F1 student visa holder. But things isn't getting well between each other and I want to get divorced. I have met a very nice cuban girl who has the US residency, we decided to get married in a month or so after my divorcing my current wife, and she is willing to help me to with my immigration status and residency.
My question is that will i be out of status in the time between my getting divorce and my new marriage. Do i need to change my status to a tourist before marriage?

You are out of status the moment you are not resident with the F1
holder.
You will be out of status and an illegal in the US for about 5 years or
more by petitioning for a green card by your potential new wife because
she is only a PR and not a citizen. During this time you cannot work.
This is not a smart move.
