I suppose you will have to be content with being a user under your husband's card if he is able to put you under it that is. If not, then you are forced into using your bank debit card for credit card purchases.

While his employer said he would initiate the processing of green cards for your spouse and you, he doesn't have to do so. And if he does, it takes time to go through the process.

It is unfortunate that your husband had to obtain a H visa to live and work in the US because it makes life miserable for you.

BTW be careful where you volunteer. Not all volunteer work is available for you. If it is a 'job' that someone else is being paid to do, then you cannot do it, even as a volunteer. That's my take on it.

That's how I feel with "a visa from hell"!! How long will the process take for a green card. He said he wanted to start collecting all the paper work in march-April. I found a couple of places to volunteering but they seems not to know what to do because I don't have a ss. I thought because I'm not getting paid I didn't need one. I was ready to go back to the UK and go back to work and "feel normal" but I don't want to split the family.

You don't need a SS number to do volunteer work. Be upfront with them and tell them that you don't have one and aren't allowed to accept gainful employment but are able to do volunteer work with renumeration.

As for the length of time to get a green card, I would suggest you search the forum for an answer or at least the USCIS website. Not sure if a labor certificate is required to convert an H to a green card. If it is, then it could take a year or more.

Here is a website that details the H visa to Green Card process.

Here is the link to a current poster who is going through the process. Note he is anticipating an interview date of January 2017 and he started in 2015.

Yes I remember my husband telling me that his employer was getting to ready to file for a labour certificate first because if that's not accepted they cannot go for a green card. I can now see the problems of not having a ss I didn't know I had to tell them I didn't have one for volunteering.

You are, however, eligible for an ITIN - which you apply for with the 2016 tax return. It serves many functions similar to a SSN.

It might sound like a silly question but do I need to fill out a tax return even if I'm not working? I know my husband has to fill one out but his employer told him that unless he is declaring me as an dependant he shouldn't add me to it. Is that correct?

No. However, your husband can (and likely should) file as "married, filing jointly" - if for no other reason than to claim you as a dependent which results in either a lower tax amount due or a higher tax return... either of which is to your financial advantage.

The employer isn't necessarily wrong - and if your husband isn't claiming you as a dependent, he doesn't need to add you. However, he should... because it benefits you both financially - perhaps considerably! The employer doesn't get to make that decision for you... you do!

Thank you so much for explaining.
I don't know if it's me but I don't seems to find informations as easily as the UK. I find that I often get contradictory informations even in the same office. It might sound silly too but aside from the internet is there a way I can still watch all the British channels on my TV (my husband keeps telling me to adapt... but I'm there's still soo much I miss from home ).

Join the discussions in the USA general and take it outside forums. There are several threads on British tv streaming.
