Default last minute AOS filing questions

Hi all!

My wife is going to mail off her AOS application tomorrow! Just some last minute questions we had:

1. We have filled out the I-485A supplement form. We have
followed the steps on the form and have gotten to the point
where it says "STOP. Do not file this form". Do we still include
it with the application to show that we have filled it out? Or
do we not include it at all?

2. Do I include the fingerprint fee with the application?

Any other advice or tips (or prayers) would be greatly appreciated.

thanks,

- khabibiuf

if it says "do not file this form" then don't file it.

and if mailing the forms, yes, include the fingerprint fee. there have been reports
of people getting their packages returned for not including it.

A couple more questions:

1. Is a copy of the marriage certificate required? I can't find it anywhere on the I-485 form but I have seen that others have submitted this ( personal stories on www.kamya.com/aos).

2. How should I submit the actual papers? Should I staple the sub-applications individually and paper clip them all together? Or should I just staple the whole application? What is an easy way to submit the pictures? I was planning to put them in a small envelope and paperclip it to the front of the application.

Thanks for the advice!

Hi!

On the first page of my I-485 in Part 2 section c it says after the check box :-

"I entered as a K-1 fiance(e) of a US citizen whom I married within 90 days of entry
or I am the K-2 child of such a fiance(e). [Attach a copy of the fiance(e) petition
approval notice and the marriage certificate.]"

As far as submitting them I have punched two holes in the top edge of all my
documents and fixed them together with Acco fasteners. I've put the photographs for
each application and the checks for each application in separate clearly marked
envelopes attached to the appropriate application.

What are ACCO fasteners? Are they the kind that push into the hole and then the legs separate at the other side?

No that is not them. An ACCO fastener is a l_l-shaped lightweight metal contraption. The papers after two hole punching are slipped over the two prongs and then are closed by slipping a metal bar over them and bending the prongs inward.

If you don't work in and office and can't get your hands on one of these fasteners (thing they are only sold in boxes of 50) then just place each petition together with its attachments in a pile and paperclip them together.

Here's the final checklist for the I-485, is there anything missing?
(my wife is on a K3)

· Check for $305 (application fee + fingerprint fee)
· Form I-485, application for permanent residence.
· Photocopy of my birth certificate
· Photocopy of K3 visa in my passport.
· ADIT worksheet
· Two (2) ADIT photographs in an envelope with my
name and A#
· Form G-325A, biographic information.
· Copy of both sides of my I-94.
· Vaccination supplement (K3 visa requirement)
· Affidavit of Support
· Letter from employer
· Letter from bank
· Copy of last 3 years of Income Tax Returns
· Copy of the I-797 Notice of Action showing approval of
the I-129F petition
· Copy of the I-797 Notice of Action showing submission
of the I-130 Petition
· Signed statement that copies of documents submitted
are exact unaltered photocopies of originals.

I am not including the W2's for the Income tax returns. I believe these are only required if a joint return is filed and I want to show my income separately.

Thanks for all the help over the past few months everybody!!!

Hi,

It may be being fussy but I've heard that it is better to write a separate check
for each fee i.e. $255 for the I-485 and $50 for fingerprinting rather than a
single check.
