L1a to H2 before H1b?
Hi,
I need some advice. I have been working in the US since June 2001 on an L1a visa (executive transfer). The company I was working for is undergoing yet another severe round of redundancies (1/3 of all staff), which includes me. So my L1a is obviously not valid any more.
My wife is also working over here on an H1b. Should I transfer to an H2 on the back of her visa straight away or wait until I can find a new job that qualifies for a new H1b for myself?
What sort of timescale do I legaly have between my last day with my previous employer and applying for the H2 or even H1b?
Any advice you can give would be appreciated.

You'll probably get a better answer if you ask in alt.visa.us which deals
with L-1/H-1 visas. Certainly transferring to an H-4 (note it's an H-4 for
dependents of H-1Bs, not an H-2) will be safe. There are rules about
transferring to H-1Bs and starting work prior to approval but I believe they
only apply to going from H-1B to H-1B, not from L-1.
