Question ITIN number for E2 dependents- advice please!

Morning
We are getting ready to submit the W7 form for ITIN numbers for our kids.

We are here on an E2 visa. I am confused about which one of the following applies to the kids? Any help is much appreciated! Thank you You are in one of the following categories:

· Nonresident alien who is required to file a U.S. tax return

· U.S. resident alien who is (based on days present in the United States) filing a U.S. tax return

· Dependent or spouse of a U.S. citizen/resident alien

· Dependent or spouse of a nonresident alien visa holder- I THINK THIS ONE APPLIES???

· Nonresident alien claiming a tax treaty benefit

· Nonresident alien student, professor or researcher filing a U.S. tax return or claiming an exception

An E2 visa is an alien visa. You may in fact fall within the second bullet point if you are physically present in the U.S. -> https://www.irs.gov/individuals/inte...-presence-test

If you have not be physically present in the U.S. for the required period, you may be considered non-resident.

I believe for IRS purposes you are considered a resident alien therefore they are dependents of resident alien.
