ITIN number for E2 dependents- advice please!
Morning
We are getting ready to submit the W7 form for ITIN numbers for our kids. We are here on an E2 visa. I am confused about which one of the following applies to the kids? Any help is much appreciated! Thank you You are in one of the following categories: · Nonresident alien who is required to file a U.S. tax return · U.S. resident alien who is (based on days present in the United States) filing a U.S. tax return · Dependent or spouse of a U.S. citizen/resident alien · Dependent or spouse of a nonresident alien visa holder- I THINK THIS ONE APPLIES??? · Nonresident alien claiming a tax treaty benefit · Nonresident alien student, professor or researcher filing a U.S. tax return or claiming an exception |
Re: ITIN number for E2 dependents- advice please!
An E2 visa is an alien visa. You may in fact fall within the second bullet point if you are physically present in the U.S. -> https://www.irs.gov/individuals/inte...-presence-test
If you have not be physically present in the U.S. for the required period, you may be considered non-resident. |

I believe for IRS purposes you are considered a resident alien therefore they are dependents of resident alien.
