HELP.. my fiance in US and I'm in UK

Unhappy HELP.. my fiance in US and I'm in UK

Hi,

I was offered a job and just found out my boss had been messing me around for a whole year.
My fiance is in US and I want to be with him desperately.
I want to know what options we have to be together in US and whats the fastest and best way.
I know fiance visa takes a long time.
I was thinking of just going over to SF on visa waiver program and getting married... has anyone done this? if so, did you have any problems going back to US?
I really am REALLY desperate, i have just had enough, my stupid boss.

Hope someone can help me..

Hi Sweet,

This is a tricky one, you want to rush into this to escape from something else (your boss). The way to go here would be to go through the K1 visa, it can take a while but (relatively) is quite quick.

You could go over there on a VW and get married then file for an AOS but this is frowned upon (in fact on the US London Embassy web site it is very particular about that not being allowed). If you do this then the main problems will be getting in the country (if they suspect your intention is to come in and get married you may get turned away at your POE. The other problem would be convincing the INS on your AOS interview that your wedding was spur of the moment and wasn't planned.

You can go over on a VW as long as you are leaving the US after the wedding - this would mean filing an I-130 and a K3 after the wedding which could take a while.

I cannot tell you what option you choose and I know this is difficult choice for you especially if you are unhappy in your job and this looks like the great escape but you have to be sensible about this. If you can stick your job out for a few more months (which if you think about it will have Christmas in there) I would suggest you go the K1 route – more for peace of mind, if its all above board you will have no niggly worries about anything.

I don't want to have a bad record with INS and i don't want to upset INS.

I have spoken to my fiance and I am going to try and get a B1 business visa for 6 months, and we will get married within the 6 months and change status. This will just mean I can be with my babe for as long as poss.

The lawyer says that can be done.

We personally had bad vibes with the B1. EVERYONE is having issues with the INS here... check out the New York Times article on how bad the situation is, even these Grammy winners could not get into the States.

Personally speaking, begin investigating Direct Consular Filing with the US Embassy there. Aside from a delay with getting our UK police certificate, I would recommend that avenue. Let me know if you have questions, happy tp help!

Default embassy filing

Embassy filling (i.e. London) is a LOT quicker and less hasle than using the US INS site route. No massively long queues/lines outside to wait in, for starters. The US Embassy London has a good reputation for completion times (yeah there will be the odd few papers that get delayed..) , especially when compared against the INS offices in the US. Houston is particularly bad from what I hear.
